OPTIONAL CAR RENTAL
COLLISION COVERAGE
Coverage does not apply in countries or states where the sale of
this insurance is prohibited by law. If the Insured rents a car from a
licensed auto rental company while on his/her Trip, and the car is
damaged due to collision, vandalism, windstorm, fire, hail or flood,
while in his/her possession, the Insurer will pay the lesser of this
benefit up to the Maximum Limit shown on the Schedule of
Benefits subject to a $250 deductible: (a) the cost of repairs and
rental charges imposed by the rental company while the car is being
repaired; or (b) the Actual Cash Value of the car.
Coverage is provided to the Insured and Traveling Companion,
providing the Insured and Traveling Companion are licensed drivers,
and are listed on the rental agreement. This coverage is primary to
other forms of insurance or indemnity.
>Additional Exclusions: In addition to the General Exclusions,
coverage is not provided for loss due to: (a) any loss which occurs if
the Insured or his/her Traveling Companion is in violation of the
rental agreement; (b) rentals of trucks, campers, trailers, off-road
vehicles, motor bikes, motorcycles, recreational vehicles, or Exotic
Vehicles; (c) any obligation the Insured or his or her Traveling
Companion assumes under any agreement except insurance
collision deductible; (d) failure to report the loss to the proper local
authorities and the rental car company; (e) damage to any other
vehicle, structure, or person as a result of a covered loss; (f) driving
under the influence of alcohol; (g) Injury sustained while committing
or attempting to commit a crime (not applicable in FL.)
The Insured?s Duties in the Event of Loss: The Insured must: take
all reasonable, necessary steps to protect the vehicle and prevent
further damage to it; report the loss to the appropriate local
authorities and the rental company as soon as possible; obtain all
information on any other party involved in an accident, such as
name, address, insurance information, and driver?s license number;
and provide the Insurer all documentation such as rental agreement,
police report, and damage estimate.

TRANSPORTATION PAK UPGRADE
If You have purchased the Transportation Pak upgrade
in addition to Your Travelex Passenger Protection Plan,
You will receive the Collision Damage Waiver, Roadside
Assistance Service and Flight Accidental Death and
Dismemberment benefi ts. Benefi t coverage is per Plan,
1 Pak allowed per Plan.
COLLISION DAMAGE WAIVER
If You rent a car while on the Covered Trip, and the car is damaged due to collision, theft, vandalism, windstorm, fire, hail, flood or any cause not within Your control while in Your possession, the Company will pay the lesser of:
- (a) the cost of repairs and rental charges imposed by the rental company while the car is being repaired; or
- (b) the Actual Cash Value of the car, meaning purchase price less depreciation; or
- (c) the amount shown on the Confirmation of Coverage.
The following duties apply in the event of Loss:
- You must take all reasonable, necessary steps to protect the vehicle and prevent further damage to it;
- You must report the Loss to the appropriate local authorities and the rental company as soon as possible;
- You must obtain all information on any other party involved in an Accident, such as name, address, insurance information and driver?s license number;
- You must provide the Company all documentation such as rental agreement, police report and damage estimate.
Coverage is provided to You, provided You and Your Traveling Companions are licensed drivers, and are listed on the rental agreement. Coverage is not available to residents of Texas and Oregon.
This benefit does not apply to cars rented in Jamaica, Republic of Ireland, Northern Ireland and Israel.
ROADSIDE ASSISTANCE
Emergency Roadside Assistance is available 24 hours
a day, 365 days a year. You are responsible for any
non-covered expenses or covered costs in excess of
Your $50 per occurrence maximum. Service must be a
covered benefi t under the terms and conditions of this
contract while You are on a scheduled Covered Trip
and is available only for the specifi c Covered Vehicle
registered as part of this agreement. Covered Vehicle
means only that vehicles, which is rated 3/4 ton in weight
or less, not used for racing, rentals, dealer services,
dealer loaners, taxi, limousine, shuttle, delivery, hauling,
towing, road repair service, construction service, snow
removal, or as a public livery vehicle, or any other
commercial use that is purchased or leased.
All of the services provided are described herein and are
applicable throughout the United States and Canada.
All 24 Hour Roadside Assistance services are provided
by Brickell Financial Services Motor Club, Inc. dba Road
America Motor Club, administrative offi ces at 7300
Corporate Center Drive, Suite 601, Miami, FL 33126.
For Mississippi and Wisconsin customers, services are
provided by Brickell Financial All Services Motor Club.
For California customers, services are provided by
Road America Motor Club, Inc.
Just call the TOLL-FREE number, 1-800-693-5314 and
a service vehicle will be dispatched to Your assistance.
Important: Please be with Your Covered Vehicle when
the service provider arrives, as they cannot service an
unattended vehicle. Note: Only one service call for
the same cause will be covered during any seven-day
period.
Covered Services include:
- Towing Assistance - When towing is necessary,
Your Covered Vehicle will be towed to the nearest
qualifi ed service facility.
- Flat Tire Assistance - Service consists of the removal
of the fl at tire and its replacement with the spare tire.
- Fuel, Oil, Fluid and Water Delivery Service - An
emergency supply of fuel, oil, fl uid and water will be
delivered if You are in immediate need. You must
pay for the fl uid when it is delivered.
- Lock-out Assistance - If Your keys are locked inside
a compartment of Your Covered Vehicle, assistance
will be provided to supply assistance in gaining
entry into the locked compartment.
- Battery Assistance - If battery failure occurs, a jump
start will be provided to start Your Covered Vehicle.
- Collision Assistance - If Your Covered Vehicle is
involved in a collision, towing assistance will be
provided when needed to direct the Vehicle to the
nearest qualifi ed repair facility.
The following items are not included as part of the
emergency roadside assistance benefit:
Cost of parts, replacement keys, fluids, cost of fuel,
material, additional labor relating to towing, or the cost
of installation of products. Non-emergency mounting or
removing of any tires, snow tires, off-road tires, or similar
items. Tire Repair at any location other than a roadside
disablement site. Service for any Vehicles in tow. Any
and all taxes or fi nes. Damage or disablement due to
fi re, fl ood, terrorism or vandalism. Winching, Extrication,
Towing from, service or repair work performed at a
service station, garage or repair shop. Service on a
Covered Vehicle that is not in a safe condition to be
towed. Non-emergency towing or other non-emergency
service. Impound towing or towing by other than an
authorized service provider; Vehicle storage charges;
a second tow for the same disablement. Towing or
service on roads not regularly maintained, such as sand
beaches, open fi elds, forests, and areas designated
as not passable due to construction, etc. Towing at
the direction of a law enforcement offi cer relating to
traffi c obstruction, impoundment, abandonment, illegal
parking, or other violations of law. Coverage shall not
be provided in the event of emergencies resulting
from the use of intoxicants or narcotics, or the use of
the Covered Vehicle in the commission of a felony.
Repeated service calls for a Covered Vehicle in need
of routine maintenance or repair. Only one disablement
for the same cause during any seven-day period will
be accepted. Services obtained independently of Road
America. This is not a Reimbursement Service.
FLIGHT ACCIDENTAL DEATH & DISMEMBERMENT
You are eligible for benefits as the result of an Accident:
- Received while a passenger on a regularly scheduled airline flight or regularly scheduled charter operated; on scheduled air transportation pursuant to economic authority issued by the Civil Aeronautics Board; by an Intrastate scheduled airline of United States registry maintaining regularly published schedules and licensed for the transportation of passengers by a duly constituted authority having jurisdiction over civil aviation in the state in which said airline operates; or by a scheduled airline of foreign registry maintaining regularly published schedules and licensed for transportation of passengers by the duly constituted governmental authority having jurisdiction over civil aviation in the country of registry of such airline;
- Received while a passenger on any aircraft, other than a single-engine jet, which at the time is making a flight for the principal purchase of transporting passengers and not for any other operational, tactical or test purpose and which is operated by the Military Airlift Command of the United States, the Royal Canadian Air Force Air Transport Command, or the Royal Air Force Air Transport Command of Great Britain;
- Received while a passenger on any land or water conveyance provided at the expense of the air carrier as a substitute for an aircraft covered by this Policy;
- Received while a passenger on a vehicle licensed to carry passengers for hire, but only when:
(a) going to an airport to board an aircraft on which You are covered by this Policy; or
(b) when leaving an airport after alighting from such an aircraft;
- Received while upon airport premises designated for passenger use immediately before boarding or immediately after alighting from an aircraft on which You are covered under this Policy. Benefits will be paid equal to the amount purchased for accidental death or dismemberment when You sustain Injuries resulting in any of the following Losses within 181 days from the date of the Accident:

Loss of hand or hands, or foot or feet, means severance at or above the wrist joint or ankle joint, respectively. Loss of eye or eyes means the total and irrecoverable Loss of the entire sight thereof. Only the largest applicable
amount shown above will be paid for the Injuries resulting from one Accident. The benefit for Loss of:
(a) two extremities;
(b) both eyes; or
(c) one extremity and one eye is payable only when such Loss results from the same Accident.
If, while covered by this benefit, You are unavoidably exposed to the elements because of an eligible Accident and suffer a Loss for which benefits are payable under this benefit, such Loss will be payable under this Policy.
If, while eligible for this benefit, You are in an Accident resulting in the disappearance, sinking or damaging of an air or water conveyance on which You are scheduled under this Policy, and Your body has not been found within fifty-two (52) weeks from the date of the Accident, it will be presumed, unless there is evidence to the contrary, that You suffered a Loss of life as a result of those Injuries.
Flight Accident Option also includes a medical expense feature that pays Eligible Expenses up to $50 for each $1,000 of the chosen benefit amount. If medical expense occurs within fifty-two (52) weeks of an eligible Accident
,
You will be paid for Eligible Medical Expenses as well as home health care from a licensed home health agency, but only if continued Hospital care would have otherwise been required; attendance of a registered graduate nurse; X-ray examination; or, use of an ambulance.
Loss must occur within one hundred eighty-one (181) days of the Accident. To receive benefits, Loss must be independent of illness or disease and all other causes.
LIMITATIONS AND EXCLUSIONS
The following exclusions apply to Optional Collision
Damage Waiver:
The Company will not provide benefi ts for any Loss or
damage to:
- Any obligation You assume under any agreement
(except insurance collision deductible);
- Rentals of trucks, campers, trailers, off-road or
four-wheel drive vehicles, motor bikes, motorcycles,

- Any Loss that occurs if You are in violation of the

EXCESS INSURANCE LIMITATION
The insurance provided by the Policy for all coverages except Trip
Cancellation and Interruption, Car Rental Collision Coverage and
Medical Expense shall be in excess of all other valid and collectible
insurance or indemnity. If at the time of the occurrence of any Loss
payable under the Policy there is other valid and collectible insurance
or indemnity in place, the Insurer shall be liable only for the excess
of the amount of Loss, over the amount of such other insurance or
indemnity, and applicable deductible.

covered Loss;
(f) participation in contests of speed, motor sport or motor racing
including training or practice for the same;
(g) driving under the influence of alcohol;
(h) being under the influence of drugs or intoxicants, unless
prescribed by a Physician;
(i) war or act of war, whether declared or not, civil commotion,
insurrection or riot;
(j) Injury sustained while committing or attempting to commit a
crime.
Car Rental Collision Coverage Payment of Loss: The Insured must:
take all reasonable, necessary steps to protect the vehicle and prevent
further damage to it; report the Loss to the appropriate local authorities
and the rental company as soon as possible; obtain all information on
any other party involved in an accident, such as name, address,
insurance information, and driver?s license number; and provide Travel
Guard all documentation such as rental agreement, police report, and
damage estimate.
Notice of Loss. If the Insured's property covered under the Policy is
lost or damaged, the Insured must:
(a) notify Travel Guard as soon as possible;
(b) take immediate steps to protect, save and/or recover the covered
property;
(c) give immediate notice to the carrier or bailee who is or may be
liable for the loss or damage;
(d) notify the police or other authority in the case of robbery or theft
within 24 hours.
Proof of Loss. The Insured must furnish the Insurer with proof of loss.
Proof of loss includes police or other local authority reports or
documentation from the appropriate party responsible for the loss. It
must be filed within 90 days from the date of loss. Failure to comply
with these conditions shall not invalidate any claims under the Policy.
Settlement of Loss. Claims for damage and/or destruction shall be
paid immediately after proof of the damage and/or destruction is
presented to the Insurer. Claims for lost property will be paid after the
lapse of a reasonable time if the property has not been recovered. The
Insured must present acceptable proof of loss and the value.
Valuation. The Insurer will not pay more than the Actual Cash Value
of the property at the time of loss. At no time will payment exceed
what it would cost to repair or replace the property with material of like
kind and quality.
Disagreement Over Size of Loss. If there is a disagreement about
the amount of the loss either the Insured or the Insurer can make a
written demand for an appraisal. After the demand, the Insured and
the Insurer each select their own competent appraiser. After
examining the facts, each of the two appraisers will give an opinion on
the amount of the loss. If they do not agree, they will select an
arbitrator. Any figure agreed to by 2 of the 3 (the appraisers and the
arbitrator) will be binding. The appraiser selected by the Insured is paid
by the Insured. The Insurer will pay the appraiser it chooses. The
Insured will share with us the cost for the arbitrator and the appraisal
process.
Benefit to Bailee. This insurance will in no way inure directly or
indirectly to the benefit of any carrier or other bailee. |

3. any loss which occurs if You or anyone traveling with You are in violation of the rental agreement;
4. failure to report the loss to the proper local authorities and the rental car company;

6. any loss as the result of or attributed to driving the rental vehicle: while under the influence of alcohol or any illegal substance or the abuse of a legal substance; while using any medication which recommends abstinence from driving; in a speed competition; for compensation for hire; for illegal trade purposes, or transporting contraband;
7. any loss as the result of physical damage or loss attributed to: mechanical failure or breakdown of the rental vehicle; wear and tear, gradual deterioration, corrosion, rust or freezing; any neglect or abuse of the vehicle; any dishonest act or conversion; any consequence of war (declared or otherwise); or contamination by a radioactive material.
“Exotic Vehicles” includes Alfa Romeo, Aston Martin, Auburn, Avanti, Bentley, Bertone, BMC/Leyland, BMW M Series, Bradley, Bricklin, Clenet, Corvette, Cosworth, De Lorean, Excalibre, Ferrari, Iso, Jaguar, Jensen Healy, Lamborghini, Lancia, Lotus, Maserati, Mercedes Benz, MG, Morgan, Pantera, Panther, Pininfarina, Porsche, Rolls Royce, Rover, Stutz, Sterling, Triumph, and TVR, or any other car with a Manufacturers Suggested Retail Price (MSRP) over $40,000.

You will receive the Collision Damage Waiver, Roadside

Dismemberment benefits. Benefit coverage is per Plan,
1 Pak allowed per Plan.
COLLISION DAMAGE WAIVER
If You rent a car while on the Covered Trip, and the car is damaged due to collision, theft, vandalism, windstorm, fire, hail, flood or any cause not within Your control while in Your possession, the Company will pay the lesser of:
- (a) the cost of repairs and rental charges imposed by the rental company while the car is being repaired; or
- (b) the Actual Cash Value of the car, meaning purchase price less depreciation; or
- (c) the amount shown on the Confirmation of Coverage.
The following duties apply in the event of Loss:
- You must take all reasonable, necessary steps to protect the vehicle and prevent further damage to it;
- You must report the Loss to the appropriate local authorities and the rental company as soon as possible;
- You must obtain all information on any other party involved in an Accident, such as name, address, insurance information and driver?s license number;
- You must provide the Company all documentation such as rental agreement, police report and damage estimate.
Coverage is provided to You, provided You and Your Traveling Companions are licensed drivers, and are listed on the rental agreement. Coverage is not available to residents of Texas and Oregon.
This benefit does not apply to cars rented in Jamaica, Republic of Ireland, Northern Ireland and Israel.
ROADSIDE ASSISTANCE
a day, 365 days a year. You are responsible for any
non-covered expenses or covered costs in excess of
Your $50 per occurrence maximum. Service must be a
covered benefi t under the terms and conditions of this
contract while You are on a scheduled Covered Trip
and is available only for the specifi c Covered Vehicle
registered as part of this agreement. Covered Vehicle
means only that vehicles, which is rated 3/4 ton in weight
or less, not used for racing, rentals, dealer services,
dealer loaners, taxi, limousine, shuttle, delivery, hauling,
towing, road repair service, construction service, snow
removal, or as a public livery vehicle, or any other
commercial use that is purchased or leased.
All of the services provided are described herein and are
applicable throughout the United States and Canada.
All 24 Hour Roadside Assistance services are provided
by Brickell Financial Services Motor Club, Inc. dba Road
America Motor Club, administrative offi ces at 7300
Corporate Center Drive, Suite 601, Miami, FL 33126.
For Mississippi and Wisconsin customers, services are
provided by Brickell Financial All Services Motor Club.
For California customers, services are provided by
Road America Motor Club, Inc.
Just call the TOLL-FREE number, 1-866-296-9356 and
a service vehicle will be dispatched to Your assistance.
Important: Please be with Your Covered Vehicle when
the service provider arrives, as they cannot service an
unattended vehicle. Note: Only one service call for
the same cause will be covered during any seven-day
period
Covered Services include:
- Towing Assistance - When towing is necessary,
Your Covered Vehicle will be towed to the nearest
qualified service facility.
- Flat Tire Assistance - Service consists of the removal
of the fl at tire and its replacement with the spare tire.
- Fuel, Oil, Fluid and Water Delivery Service - An
emergency supply of fuel, oil, fl uid and water will be
delivered if You are in immediate need. You must
pay for the fluid when it is delivered.
- Lock-out Assistance - If Your keys are locked inside
a compartment of Your Covered Vehicle, assistance
will be provided to supply assistance in gaining
entry into the locked compartment.
- Battery Assistance - If battery failure occurs, a jump
start will be provided to start Your Covered Vehicle.
- Collision Assistance - If Your Covered Vehicle is
involved in a collision, towing assistance will be
provided when needed to direct the Vehicle to the
nearest qualified repair facility.
The following items are not included as part of the
emergency roadside assistance benefit:
Cost of parts, replacement keys, fluids, cost of fuel,
material, additional labor relating to towing, or the cost
of installation of products. Non-emergency mounting or
removing of any tires, snow tires, off-road tires, or similar
items. Tire Repair at any location other than a roadside
disablement site. Service for any Vehicles in tow. Any
and all taxes or fines. Damage or disablement due to
fire, flood, terrorism or vandalism. Winching, Extrication,
Towing from, service or repair work performed at a
service station, garage or repair shop. Service on a
Covered Vehicle that is not in a safe condition to be
towed. Non-emergency towing or other non-emergency
service. Impound towing or towing by other than an
authorized service provider; Vehicle storage charges;
a second tow for the same disablement. Towing or
service on roads not regularly maintained, such as sand
beaches, open fields, forests, and areas designated
as not passable due to construction, etc. Towing at
the direction of a law enforcement officer relating to
traffic obstruction, impoundment, abandonment, illegal
parking, or other violations of law. Coverage shall not
be provided in the event of emergencies resulting
from the use of intoxicants or narcotics, or the use of
the Covered Vehicle in the commission of a felony.
Repeated service calls for a Covered Vehicle in need
of routine maintenance or repair. Only one disablement
for the same cause during any seven-day period will
be accepted. Services obtained independently of Road
America. This is not a Reimbursement Service.
FLIGHT ACCIDENTAL DEATH & DISMEMBERMENT
You are eligible for benefits as the result of an Accident:
- Received while a passenger on a regularly scheduled airline flight or regularly scheduled charter operated; on scheduled air transportation pursuant to economic authority issued by the Civil Aeronautics Board; by an Intrastate scheduled airline of United States registry maintaining regularly published schedules and licensed for the transportation of passengers by a duly constituted authority having jurisdiction over civil aviation in the state in which said airline operates; or by a scheduled airline of foreign registry maintaining regularly published schedules and licensed for transportation of passengers by the duly constituted governmental authority having jurisdiction over civil aviation in the country of registry of such airline;
- Received while a passenger on any aircraft, other than a single-engine jet, which at the time is making a flight for the principal purchase of transporting passengers and not for any other operational, tactical or test purpose and which is operated by the Military Airlift Command of the United States, the Royal Canadian Air Force Air Transport Command, or the Royal Air Force Air Transport Command of Great Britain;
- Received while a passenger on any land or water conveyance provided at the expense of the air carrier as a substitute for an aircraft covered by this Policy;
- Received while a passenger on a vehicle licensed to carry passengers for hire, but only when:
(a) going to an airport to board an aircraft on which You are covered by this Policy; or
(b) when leaving an airport after alighting from such an aircraft;
- Received while upon airport premises designated for passenger use immediately before boarding or immediately after alighting from an aircraft on which You are covered under this Policy. Benefits will be paid equal to the amount purchased for accidental death or dismemberment when You sustain Injuries resulting in any of the following Losses within 181 days from the date of the Accident:

Loss of hand or hands, or foot or feet, means severance at or above the wrist joint or ankle joint, respectively. Loss of eye or eyes means the total and irrecoverable Loss of the entire sight thereof. Only the largest applicable
amount shown above will be paid for the Injuries resulting from one Accident. The benefit for Loss of:
(a) two extremities;
(b) both eyes; or
(c) one extremity and one eye is payable only when such Loss results from the same Accident.
If, while covered by this benefit, You are unavoidably exposed to the elements because of an eligible Accident and suffer a Loss for which benefits are payable under this benefit, such Loss will be payable under this Policy.
If, while eligible for this benefit, You are in an Accident resulting in the disappearance, sinking or damaging of an air or water conveyance on which You are scheduled under this Policy, and Your body has not been found within fifty-two (52) weeks from the date of the Accident, it will be presumed, unless there is evidence to the contrary, that You suffered a Loss of life as a result of those Injuries.
Flight Accident Option also includes a medical expense feature that pays Eligible Expenses up to $50 for each $1,000 of the chosen benefit amount. If medical expense occurs within fifty-two (52) weeks of an eligible Accident
,
You will be paid for Eligible Medical Expenses as well as home health care from a licensed home health agency, but only if continued Hospital care would have otherwise been required; attendance of a registered graduate nurse; X-ray examination; or, use of an ambulance.
Loss must occur within one hundred eighty-one (181) days of the Accident. To receive benefits, Loss must be independent of illness or disease and all other causes.
LIMITATIONS AND EXCLUSIONS
The following exclusions apply to Optional Collision
Damage Waiver:
The Company will not provide benefi ts for any Loss or
damage to:
- Any obligation You assume under any agreement
(except insurance collision deductible);
- Rentals of trucks, campers, trailers, off-road or
four-wheel drive vehicles, motor bikes, motorcycles,
recreational vehicles or Exotic Vehicles;
- Any Loss that occurs if You are in violation of the
rental agreement;
- Failure to report the Loss to the proper local
authorities and the rental car company;
- Damage to any other vehicle, structure or person
as a result of a covered Loss.

2) riot, civil commotion;
3) fire explosion, or Natural Disaster; or
4) collision with another object or by upset. Only one Rental Vehicle at a time may be covered under the Policy.
NOTE: It is Your responsibility to examine the Rental Vehicle, prior to Your acceptance of such vehicle, for any existing damage and to retain a copy of the written record of such damage for submission to Us in the event of a claim. Coverage is provided for any loss or physical damage to the Rental Vehicle anywhere in the world and includes payment of towing costs, fire department charges, damage repairs, salvage, and civil action defense costs on account of such loss or damage.
Rental Vehicle: means any motor vehicle rented from a Commercial Rental Vehicle Agency as described in the rental agreement.
A Rental Vehicle does not include trucks, vans, buses, motorcycles, mopeds, motorbikes, recreational all-terrain vehicles, campers, trailers, limousines, and vehicles 20 years of age or older, any vehicles specifically designed for off-road use and any exotic vehicles including, but not limited to Aston Martin, Bentley, Bricklin, Daimler, De Lorean, Excalibur, Ferrari, Jensen, Lamborghini, Lotus, Maserati, Mercedes Benz, Porsche, Rolls Royce, or any other similar vehicle. Rental Vehicle Damage Protection: Coverage ends on the earliest of the following:
a) the Rental Vehicle return date as shown on Your enrollment form;
b) the date You return the Rental Vehicle to the Commercial Rental Vehicle Agency; or
c) the date the Rental Vehicle was scheduled to be returned to the Commercial Rental Vehicle Agency as stipulated in the rental agreement.
YOUR DUTIES IN THE EVENT OF LOSS OF OR DAMAGE TO YOUR RENTAL VEHICLE
When physical loss of or damage to Your Rental Vehicle occurs during the rental period, You must immediately:
1) report such loss or damage to the Commercial Rental Vehicle Agency and provide to the agency full details of the circumstances surrounding the loss of or damage to the Rental Vehicle;
2) file a report with the police documenting:
a) the accident involving the Rental Vehicle; or
b) the physical loss of or any damage to the
Rental Vehicle; and
3) notify Our authorized travel assistance company. In order to qualify for benefits under this provision, You must submit to Us, within 30 days of the date of the loss or damage, copies of:
1) the written verifi cation of the Rental Vehicle booking as made by or through the approved Commercial Rental Vehicle Agency;
2) the rental agreement;
3) any police or other reports documenting:
a) any physical loss of or damage to the Rental Vehicle;
b) the circumstances surrounding any accident in which the Rental Vehicle may have been involved;
c) the theft of or any malicious mischief or vandalism to the Rental Vehicle; and
4) any other information We deem to be necessary to properly adjudicate Your Rental Vehicle claim. Upon receipt of the necessary forms and documentation, We will investigate and negotiate the Rental Vehicle
claim on Your behalf, subject to all the terms, conditions and limitations of the Policy. We reserve the right to have the Rental Vehicle examined, at Our own expense, by an insurance adjuster of Our own choosing as often as We determine such examination to be reasonably necessary.
EXCLUSIONS In addition to any other Exclusions listed in the Policy, no coverage is provided under this provision if:
1) the Commercial Rental Vehicle Agency waives or assumes responsibility for expenses incurred
as a result of any physical loss or damage to the Rental Vehicle for which You may be liable;
2) any amounts are paid or payable under any other insurance coverage You might have.
No coverage is provided under this provision for physical loss of or damage to the Rental Vehicle caused by or resulting from:
1) driving the Rental Vehicle while You are:
a) using any medication which recommends abstinence from driving;
b) receiving compensation or hire;
c) participating in an illegal activity, or transporting contraband; or
d) in violation of the terms and conditions of the rental agreement;
2) mechanical failure or breakdown of the Rental Vehicle; wear and tear, gradual deterioration, corrosion, rust or freezing;
3) any neglect or abuse of the Rental Vehicle either by the Commercial Rental Vehicle Agency or You;
4) any conversion or modification to the Rental Vehicle by or at Your direction; or
5) contamination of the Rental Vehicle by radioactive material.

b) the date You return the Rental Vehicle to the Commercial Rental Vehicle Agency; or
c) the date the Rental Vehicle was scheduled to be returned to the Commercial Rental Vehicle Agency as stipulated in the rental agreement.
YOUR DUTIES IN THE EVENT OF LOSS OF OR DAMAGE TO YOUR RENTAL VEHICLE
When physical loss of or damage to Your Rental Vehicle occurs during the rental period, You must immediately:
1) report such loss or damage to the Commercial Rental Vehicle Agency and provide to the agency full details of the circumstances surrounding the loss of or damage to the Rental Vehicle;
2) file a report with the police documenting:
a) the accident involving the Rental Vehicle; or
b) the physical loss of or any damage to the
Rental Vehicle; and
3) notify Our authorized travel assistance company. In order to qualify for benefits under this provision, You must submit to Us, within 30 days of the date of the loss or damage, copies of:
1) the written verifi cation of the Rental Vehicle booking as made by or through the approved Commercial Rental Vehicle Agency;
2) the rental agreement;
3) any police or other reports documenting:
a) any physical loss of or damage to the Rental Vehicle;
b) the circumstances surrounding any accident in which the Rental Vehicle may have been involved;
c) the theft of or any malicious mischief or vandalism to the Rental Vehicle; and
4) any other information We deem to be necessary to properly adjudicate Your Rental Vehicle claim. Upon receipt of the necessary forms and documentation, We will investigate and negotiate the Rental Vehicle
claim on Your behalf, subject to all the terms, conditions and limitations of the Policy. We reserve the right to have the Rental Vehicle examined, at Our own expense, by an insurance adjuster of Our own choosing as often as We determine such examination to be reasonably necessary.
EXCLUSIONS In addition to any other Exclusions listed in the Policy, no coverage is provided under this provision if:
1) the Commercial Rental Vehicle Agency waives or assumes responsibility for expenses incurred
as a result of any physical loss or damage to the Rental Vehicle for which You may be liable;
2) any amounts are paid or payable under any other insurance coverage You might have.
No coverage is provided under this provision for physical loss of or damage to the Rental Vehicle caused by or resulting from:
1) driving the Rental Vehicle while You are:
a) using any medication which recommends abstinence from driving;
b) receiving compensation or hire;
c) participating in an illegal activity, or transporting contraband; or
d) in violation of the terms and conditions of the rental agreement;
2) mechanical failure or breakdown of the Rental Vehicle; wear and tear, gradual deterioration, corrosion, rust or freezing;
3) any neglect or abuse of the Rental Vehicle either by the Commercial Rental Vehicle Agency or You;
4) any conversion or modification to the Rental Vehicle by or at Your direction; or
5) contamination of the Rental Vehicle by radioactive material.
