Pre-Departure Trip Cancellation
We will pay a Pre-Departure Trip Cancellation Benefit, up to the amount in the Schedule, if you are prevented from taking your Covered Trip due to your, your Family Member’s, or Traveling Companion’s Sickness, Injury, or death that occurs before departure on your Covered Trip. The Sickness or Injury must: a) commence while your coverage is in effect under the plan; b) require the examination and treatment by a Physician, in person, at the time the Covered Trip is canceled; and c) in the written opinion of the treating Physician, be so disabling as to prevent you from taking your Covered Trip.We will pay a benefit if you are prevented from taking your Covered Trip due to Other Covered Events, as defined, that occur before departure on your Covered Trip.
OTHER COVERED EVENTS means only the following unforeseeable events or their consequences which occur while coverage is in effect under this Policy:
- Common Carrier delays resulting from inclement weather, or mechanical breakdown of the aircraft, ship or boat or motor coach on which you are scheduled to travel, or organized labor strikes that affect public transportation;
- arrangements canceled by an airline, cruise line, motor coach company, or tour operator, resulting from inclement weather, mechanical breakdown of the aircraft,
ship or boat or motor coach on which the Insured is scheduled to travel, or organized labor strikes that affect public transportation.
Items 1 and 2 above are subject to the following conditions:
a. the scheduled carrier connecting times must meet airline required legal minimum connect times; and
b. the scheduled time between arrival at the Scheduled Trip Departure City and the scheduled trip departure must be 2 hours or longer.
- arrangements canceled by a tour operator, cruise line,
airline, rental car company, hotel, condominium, railroad,
motor coach company, or other supplier of travel
services, resulting from Financial Insolvency;
Item 3 above is subject to your plan payment being
received prior to/or within 24 hours of your final payment
for your Covered Trip;
- a change in plans by you, a Family Member traveling with
you, or Traveling Companion resulting from one of the
following events which occurs while coverage is in effect
under this Policy:
a. being directly involved in a documented traffic accident
while en route to departure;
b. being hijacked, quarantined (except as a result of a
pandemic or epidemic), required to serve on a jury, or
required by a court order to appear as a witness in a
legal action, provided you, a Family Member traveling
with you or a Traveling Companion is not 1) A party to
the legal action, or 2) Appearing as a law
enforcement officer;
c. your Home made Uninhabitable by fire, flood, volcano,
earthquake, hurricane or other natural disaster;
d. your Accommodation at your destination made
Uninhabitable by fire, flood, volcano, earthquake,
hurricane or other natural disaster;
e. mandatory evacuation or public official evacuation
advisements where there is no mandatory evacuation
issued by local government authorities at your
destination due to adverse weather or natural disaster.
In order to cancel or interrupt your Covered Trip, you
must have 4 days or 50% of your total Covered Trip
length or less remaining on your Covered Trip at the
time the mandatory evacuation ends;
f. being called into active military service to provide aid
or relief in the event of a natural disaster;
g. a documented theft of passports or visas;
h. a transfer of employment of 250 miles or more;
i. a Terrorist Act which occurs in your departure city or in
a city which is a scheduled destination for your
Covered Trip, provided the Terrorist Act occurs within 7
days of the Scheduled Departure Date for your
Covered Trip;
j. your involuntary termination of employment or layoff,
which occurs more than 15 days after your effective
date of coverage and was not under your control. You
must have been continuously employed with the same
employer for 5 years prior to the termination or layoff.
This provision is not applicable to temporary
employment, independent contractors or
self-employed persons.
Pre-Departure Trip Cancellation Benefits
We will reimburse you, up to the amount in the Schedule, for the amount of forfeited, prepaid, non-refundable, nonrefunded, and unused published payments or deposits that you paid for your Covered Trip. We will pay your additional cost as a result of a change in the per-person occupancy rate for prepaid travel arrangements if a Traveling Companion’s Covered Trip is canceled and your Covered Trip
is not canceled. |

You have benefits in the amount purchased for unused non-refundable prepaid expenses for travel arrangements, whenever you are prevented from taking a trip for any of the following reasons that occur after the effective date * of your protection plan: - Specified sickness, injury or death of you, your traveling companion, business partner or family member of either you or your traveling companion that results in medically imposed restrictions as certified by a legally qualified physician at the time of loss, preventing your continued participation in the trip.
- If You purchase RoundTrip within ten (10) days of Your initial Trip payment* and for the full non-refundable
cost of Your Trip, You will be eligible for benefits up to a maximum limit of $20,000 or the benefit amount
protected, whichever is less, due to the Bankruptcy or Default of an airline, cruise line, or tour operator
(other than the travel agent or Travel supplier that solicited this Protection Plan and from whom You
purchased Your Travel Arrangements) which stops service more than fourteen (14) days following Your
Protection Plan Effective Date. Your scheduled Departure Date must be no more than fifteen (15) months
beyond the Effective Date of Your Protection Plan. Benefits will be paid due to Bankruptcy or Default of an
airline only if no alternate transportation is available. Coverage does not apply if the petition for Bankruptcy
was filed prior to the Effective Date of Your Protection Plan. If alternate transportation is available, benefits
will be limited to the change fee charged to allow You to transfer to another airline in order to get to Your
intended destination. The Bankruptcy or Default benefit is excess and secondary to all other forms of
indemnity.
- Strike that causes complete cessation of services of your common carrier for at least 48 consecutive hours.
- Weather that causes complete cessation of services of your common carrier for at least 48 consecutive hours.
- Employer termination or layoff affecting you or a person sharing the same room. Employment must have been with the same employer for at least three continuous years.
- Terrorism in a country, which is part of your scheduled trip, that causes the United States Department of State to issue a travel warning that you should not travel within that country for a period of time, which covers your scheduled trip.
- Hijack, quarantine, jury duty or court ordered appearance as a witness in a legal action in which you or your traveling companion are not a party (except law enforcement officers).
- Primary residence of you or your traveling companion is rendered uninhabitable due to unforeseen circumstances.
- Burglary of you or your traveling companion's primary residence within 10 days of departure or during your trip.
- Felonious assault of you or your traveling companion within 10 days of departure or during your trip.
- You or your traveling companion are called to emergency military duty for a national disaster other than war.
- Traffic accident directly involving either you or your traveling companion, substantiated by a police report, while en route to a scheduled departure point.
- If your travel supplier cancels your trip, you will receive up to $75 for the reissue fee charged by the airline for your tickets. You must cover the full cost of the trip.
* Effective Date is the date which begins at 12:01 a.m. following the: 1) postmark date of your enrollment form or 2) the date you fax or transmit your enrollment via the internet with the proper payment. |

Whenever You are prevented from taking or completing a Covered Trip as a result of any of the unforeseen events listed below, We will reimburse You up to the Maximum Benefit Amount for Trip Cancellation or Trip Interruption, for the following expenses:
- any unused non-refundable prepaid expenses for Travel Arrangements;
- any Published Penalties You incur as a result of a trip cancellation;
- one way Economy Transportation, less the value of any unused return travel ticket, to return to the Point of Origin or to continue on Your Covered Trip when an interruption in Your Covered Trip occurs; or
- up to $150 for any reissue fee charged by the airline for Your airfare if Your Travel Supplier cancels Your Covered Trip or repositions the cruise ship or departure location. You must have covered the entire cost of the Covered Trip including the airfare.
Trip Cancellation must result from an unforeseen event that occurs after Your Effective Date and before Your Scheduled Departure Date. Trip Interruption must result from an unforeseen event that occurs after Your Scheduled Departure Date.
Single Supplement Upgrade
We will reimburse You for the single supplement upgrade cost when Your Traveling Companion cancels his or her travel plans with You, or interrupts Your Covered Trip as a result of one of the unforeseen events listed below, and You decide not to cancel or interrupt Your Covered Trip.
Unforeseen Events
As used in this provision, unforeseen events are as follows:
- Any serious Injury or any serious Sickness occurring to:
a) You, which results in medically imposed travel restrictions as certified by a Physician at the time of loss;
b) Your Business Partner or a Traveling Companion, which is so disabling as to cause a reasonable person to delay, cancel, or interrupt her trip;
c) Your or Your Traveling Companion’s Family Member that is considered life threatening or requiring hospitalization; or
d) Your or Your Traveling Companion’s Family Member requiring Your or Your Traveling Companion’s immediate care.
- Your death, the death of Your Family Member, Business Partner or Your Traveling Companion or Your Traveling Companion’s Family Member.
- Bankruptcy or Default of a Travel Supplier, other than the travel agency or organization from whom You purchased the Travel Arrangements. Benefits are provided only for the expenses charged by the Travel Supplier whose Bankruptcy or Default results in loss covered by the Policy and which stops service:
a) more than 15 days following Your Policy Effective Date for Trip Cancellation; or
b) after Your Scheduled Departure Date for Trip Interruption
provided You purchased this insurance within 15 days from the date You paid the initial deposit on Your Covered Trip.
No coverage is provided for the total cessation or complete suspension of operations by a Travel Supplier caused by fraud or negligent misrepresentation by such Travel Supplier.
- A Terrorist Incident in Your city of departure or Destination occurring after Your Effective Date, if You are scheduled to arrive in or depart from that city within 30 days following the Terrorist Incident.
- Documented theft of Your or Your Traveling Companion’s passports and/or visas required for the Covered Trip.
- A traffic accident directly involving You or Your Traveling Companion, as documented by a police report, while enroute to the Point of Origin.
- Your or Your Traveling Companion’s place of business being made unsuitable for the transaction of business by fire, vandalism, burglary or Natural Disaster.
- Death, hospitalization, or quarantine of Your Host at Destination.
- You or Your Traveling Companion are hijacked, quarantined, called for jury duty, or called for a court ordered appearance as a witness (except law enforcement officers) in a legal action in which You or Your Traveling Companion are not a party.
- You or Your Traveling Companion are transferred by the employer with whom You or Your Traveling Companion are employed as a full-time active employee at the time You enrolled for this insurance. Such transfer must result in You or Your Traveling Companion having to relocate 250 miles or more from Your or Your Traveling Companion’s original Primary Residence.
- You or Your Traveling Companion being called to the emergency service of the government in response to a Natural Disaster.
- Your arrival at Your Destination is delayed and causes You to lose 50% or more of the scheduled Covered Trip duration due to any the unforeseen events covered under Trip Delay.
- Involuntary termination or layoff affecting You or Your Traveling Companion. Employment must have been on an active full-time basis and with the same employer for at least 3 continuous years immediately preceding the termination or layoff.
- An Organized Labor Strike that causes complete cessation of travel services delaying the departure of Your Covered Trip for at least 24 consecutive hours.
- Inclement Weather which causes Your Common Carrier to delay the departure of Your Covered Trip for at least 24 hours.
- Your or Your Traveling Companion’s Primary Residence or Destination accommodations being made uninhabitable during Your Covered Trip by fire, vandalism, burglary or Natural Disaster.
Your Duties in the event of Trip Cancellation or Trip Interruption
All cancellations or interruptions must be reported to the Travel Supplier within 72 hours of the unforeseen event causing the need to cancel or interrupt Your Covered Trip, unless the event prevents it, and then as soon as is reasonably possible. If the cancellation or interruption is not reported within the specified 72 hour period, We will not pay for additional expenses or charges which would not have been incurred had You notified the Travel Supplier in the specified period. If the unforeseen event prevents You from reporting the cancellation or interruption, the 72 hour notice requirement does not apply. However, You must, if requested, provide proof that the unforeseen event prevented You from reporting the cancellation or interruption within the specified period.
In order to qualify for reimbursement under this provision, You must submit to Us with Your claim:
- the date Your Covered Trip was canceled or interrupted;
- copies of Your travel invoices;
- the original, unused travel tickets or vouchers;
- Your Travel Supplier’s cancellation clause with regard to non-refundable costs, charges or expenses;
- receipts or other proofs of payment;
- detailed medical documentation if the trip cancellation or trip interruption was caused by or resulted from a serious Injury or serious Sickness; and
- any other information We deem necessary to properly adjudicate Your claim.

The Insurer will reimburse the Insured, as described
below, if a Trip is canceled or interrupted for the Insured
due to any of the following Unforeseen circumstances:
(a) Sickness, Injury, or death of an Insured, Immediate
Family Member, Traveling Companion, or Business
Partner. Injury or Sickness must be so disabling as to
reasonably cause a Trip to be canceled or interrupted. If
the Insured must cancel or interrupt his/her Trip due to
Injury or Sickness of an Immediate Family Member or
Business Partner, it must be because their condition is
life-threatening, or because the Immediate Family
Member requires the Insured’s or Traveling Companion’s
care; (b) Inclement Weather causing delay or complete
cessation of services for at least 24 consecutive hours;
(c) Strike resulting in complete cessation of travel
services at the point of departure or Destination. A Strike
is foreseeable on the date labor union members vote to
approve a Strike and is not covered under the policy; (d)
the Insured’s principal residence or Destination being
made Uninhabitable by fire, flood, or similar Natural
Disaster, vandalism, or burglary; (e) the Insured or a
Traveling Companion being subpoenaed, required to
serve on a jury, hijacked, or quarantined; (f) a Terrorist
Incident in a City listed on the Insured’s itinerary within
30 days of the Insured’s scheduled arrival. “City” means
an incorporated municipality having defined borders and
does not include the high seas, uninhabited areas, or
airspace.
Trip Cancellation Benefits: The Insurer will reimburse
the Insured for the following up to the Maximum Limit
shown on the Schedule of Benefits for Trips that are
canceled before the scheduled departure date due to the
Unforeseen events shown at the beginning of this section:
a) forfeited, non-refundable prepaid deposits or
payments, (b) the charge for a single supplement if the
Insured’s Traveling Companion Trip is cancelled but the
Insured’s is not.
The Insured must: Contact LiveTravel (1.800.826.8597)
as soon as he/she knows the Trip is going to be cancelled
or interrupted. Failure to do so may affect coverage.
In addition to the General Exclusions, coverage is not
provided for losses caused by or as a result of:
(i) travel arrangements cancelled by an airline, cruise line,
or tour operator, except as provided elsewhere in the
policy; (ii) changes in plans by the Insured, an Immediate
Family Member, or Traveling Companion, for any reason;
(iii) financial circumstances of the Insured, an Immediate
Family Member, or a Traveling Companion; (iv) any
business or contractual obligations of the Insured, an
Immediate Family Member, or Traveling Companion; (v)
Default by the person, agency, or tour operator from
whom the Insured bought his/her coverage and
purchased his/her travel arrangements; (vi) any
government regulation or prohibition; (vii) an event which
occurs prior to the Insured’s coverage Effective Date for
Trip Cancellation coverage, whether known to the
Insured or not; (ix) financial default.
The Insured’s Duties in the Event of Loss: The Insured
must provide the Insurer documentation of the
cancellation or interruption, and proof of the expenses
incurred. The Insured must provide proof of payment for
the Trip such as cancelled check or credit card
statements, proof of refunds received, copies of
applicable tour operator or Common Carrier cancellation
policies, and any other information reasonably required
to prove the loss. Claims involving loss due to Sickness,
Injury, or death require signed patient (or next of kin)
authorization to release medical information and an
attending physician’s statement. The Insured must
provide the Insurer with all unused air, rail, cruise, or
other tickets if he/she is claiming the value of those
unused tickets.. |

departure on your Trip; death or hospitalization of your Host,

is in effect under the policy; b) require the examination and

Pre-Departure Trip Cancellation Benefits: If you cancel your
Trip for a covered reason, we will reimburse you, up to the
amount in the Schedule for the amount of prepaid, forfeited,
non-refundable Payments or Deposits that you paid for your
Trip, including up to $150.00 for the cost of airline-imposed fees
to rebank frequent flyer miles for air flights to join your Trip.
We will pay your additional cost as a result of a change in the
per person occupancy rate for prepaid travel arrangements
if a Traveling Companion’s Trip is canceled and your Trip is
not canceled.
We will reimburse you up to $150.00 for the cost of an airline imposed
change or reissue fee if your Trip is canceled by a
travel supplier of land or water travel arrangements.
“Other Covered Events” means only the following unforeseeable events or their
consequences which occur while coverage is in effect under this policy:
- Air Carrier delays resulting from inclement weather, mechanical breakdown of
the aircraft on which you are scheduled to travel, or organized labor strikes
that affect public transportation;
- arrangements canceled by an airline, cruise line, or tour operator, resulting
from inclement weather, mechanical breakdown of the aircraft on which you
are scheduled to travel, or organized labor strikes that affect public
transportation.
Items #1 and #2 above apply only to Post-Departure Trip Interruption
Benefits.
- arrangements canceled by an airline, cruise line, or tour operator, resulting
from Financial Insolvency as defined.
Item #3 above is subject to your premium being received within 15
days of the initial deposit/payment for your Trip
- a change in plans by you, an Immediate Family Member traveling with you,
or Traveling Companion resulting from one of the following events
(a) being directly involved in a documented traffic accident while en route to
departure;
(b) being hijacked, quarantined, required to serve on a jury, or required
by a court order to appear as a witness in a legal action, provided you,
an Immediate Family Member traveling with you or a Traveling Companion

(h) a cancellation of your Trip if your arrival on the Trip is delayed and
causes you to lose 50% or more of the scheduled Trip duration
due to the reasons covered under the Travel Delay Benefit.
h) a cancellation of your Trip if your arrival on the Trip is
delayed and causes you to lose 50% or more of the
scheduled Trip duration due to the reasons covered under
items #1 and #2 above;
i) your involuntary termination of employment or layoff
which occurs more than 30 days after your effective
date of coverage and was not under your control. You
must have been continuously employed with the same
employer for 2 years prior to the termination or layoff.
This provision is not applicable to temporary employment,

j) a cancellation of your Trip within 24 hours of your

Pre-Departure Trip Cancellation Benefits: If you cancel your Trip for a covered reason, we will reimburse you, up to the amount in the Schedule for the amount of prepaid, forfeited, non-refundable Payments or Deposits that you paid for your Trip, including up to $150.00 for the cost of airline-imposed fees to rebank frequent flyer miles for air flights to join your Trip.
We will pay your additional cost as a result of a change in the per person occupancy rate for prepaid travel arrangements if a Traveling Companion’s Trip is canceled and your Trip is not canceled.
We will reimburse you up to $150.00 for the cost of an airline imposed change or reissue fee if your Trip is canceled by a travel supplier of land or water travel arrangements.
“Other Covered Events” means only the following unforeseeable events or their consequences which occur while coverage is in effect under this policy:
- Air Carrier delays resulting from inclement weather, mechanical breakdown of
the aircraft on which you are scheduled to travel, or organized labor strikes
that affect public transportation;

Arrangements canceled by an airline, cruise line, or tour operator, resulting
from inclement weather, mechanical breakdown of the aircraft on which you
are scheduled to travel, or organized labor strikes that affect public
transportation.
Items #1 and #2 above apply only to Post-Departure Trip Interruption Benefits. -
Arrangements canceled by an airline, cruise line, or tour operator, resulting
from Financial Insolvency as defined.
Item #3 above is subject to your premium being received within 15
days of the initial deposit/payment for your Trip

A change in plans by you, an Immediate Family Member traveling with you,
or Traveling Companion resulting from one of the following events
(a) being directly involved in a documented traffic accident while en route to
departure;
(b) being hijacked, quarantined, required to serve on a jury, or required by a court order to appear as a witness in a legal action, provided you, an Immediate Family Member traveling with you or a Traveling Companion is not 1) a party to the legal action, or 2) appearing as a law enforcement officer;
(c) your Home is made uninhabitable by fire, flood, volcano, earthquake,
hurricane or other natural disaster;
(d) being called into active military service to provide aid or relief in the event
of a natural disaster;
(e) a documented theft of passports or visas;
(f) a transfer of employment of 250 miles or more;
(g) a Terrorist Act which occurs in your departure city or in a city which is
a scheduled destination for your Trip provided: 1) the Terrorist Act occurs
within 30 days of the Scheduled Departure Date for your Trip; and 2) your
premium is received within 15 days of the initial deposit/payment for
your Trip;
(h) a cancellation of your Trip if your arrival on the Trip is delayed and
causes you to lose 50% or more of the scheduled Trip duration
due to the reasons covered under items#1 and #2 above.
i) your involuntary termination of employment or layoff
which occurs more than 30 days after your effective
date of coverage and was not under your control. You
must have been continuously employed with the same
employer for 2 years prior to the termination or layoff.
This provision is not applicable to temporary employment,
independent contractors or self-employed persons;
j) a cancellation of your Trip within 24 hours of your
Scheduled Departure Date and time if your Trip
destination is under a hurricane warning issued by the
NOAA National Hurricane Center, provided the
cancellation of your Trip occurs more than 15 days
following your effective date of coverage for the Trip

Trip Cancellation coverage provides benefits for loss(es)
You incur for Trips cancelled up to the time and date of
departure. Trip Interruption coverage provides benefits for
loss(es) You incur for Trips that are interrupted or delayed
after the time and date of departure.
For all of the covered reasons outlined below, You
must notify the appropriate travel supplier(s) of Your
cancellation or interruption within 72 hours of the
occurrence, unless the condition prevents it, then as
soon as reasonably possible. Otherwise the right to
compensation will lapse.
A maximum benefit of up to the amount indicated in Your
Letter of Confirmation is provided to cover certain
expenses as listed below which result from the cancellation
or interruption of Your Trip due to:
- Any serious Injury or any unforeseen serious medical
condition:
a. Occurring to You or a Traveling Companion, which
is so disabling as to cause a reasonable person to
delay, cancel, or interrupt their Trip;
b. Occurring to a Family Member that is considered
life threatening or requiring hospitalization; or
c. Occurring to a Family Member requiring Your
care.
For Trip Cancellation benefits, an actual examination by a
licensed Physician must take place within 72 hours of the
cancellation. For Trip Interruption benefits, this examination
must take place during Your Trip. This Physician may not
be a member of Your or Your Traveling Companion's
immediate family or yourself, or an Immediate Family
Member of the person whose condition caused the
cancellation or interruption.
- Your death, the death of a Family Member or a
Traveling Companion if the death occurs prior to Your
Scheduled Departure Date, or during Your Trip.
- Financial Default of a tour operator, airline or cruise
line provided that:
a. On the Policy effective date, the tour operator,
airline or cruise line was approved for the
Financial Default coverage by the Company. For a
current list of approved suppliers refer to
www.elvia.us , or call 1-888-489-3227; and
b. The insurance was purchased within 14 calendar
days of the initial Trip deposit or payment.
The Company will not cover losses resulting from a
Financial Default of the person, organization, agency or
tour operator, or their affiliate companies, that solicited this
coverage, and/or Your insured travel arrangements to You.
Financial Default occurring on or before the Policy effective
date or less than 7 days after the Policy effective date is
not covered. The Company reserves the right to substitute
a Trip of similar value in lieu of cash payment.
- Strikes, natural disasters, bad weather or FAA
mandated shutdown resulting in the complete
cessation of services by the airline, the tour operator
or the cruise line for at least 24 consecutive hours.
The Company will not cover losses resulting from
strikes of the person, organization, agency, or tour
operator, or their affiliate companies, that solicited this
coverage and/or Your insured travel arrangements to
You.
- You or a Traveling Companion being hijacked or
quarantined.
- You being required to serve on a jury, served with a
court order or subpoena.
- Your Primary Residence or Your Trip destination
being made uninhabitable by fire, flood, burglary,
vandalism, or natural disasters.
- You or a Traveling Companion being directly involved
in a traffic Accident while directly en route to a
departure.
- A terrorist act committed by an organized terrorist
group (recognized as such by the U.S. State
Department) that results in property damage, Injury or
loss of life. The incident must take place in a domestic
or foreign city in which You are scheduled to arrive
within 30 days following the incident and Your tour
operator (if applicable) must not have offered a
substitute itinerary. For foreign terrorism coverage
only, coverage for travel to or through countries in
which such a documented or reported incident
has occurred during the 30 days prior to purchase
of insurance is excluded. Losses resulting due to
the issuance of travel advisories, bulletin oralerts;
war or acts thereof; civil disorder, riot or unrest;
bomb scares or threats of terrorist activity; or
terrorist acts against any Common Carrier (e.g.,
airline or cruise line) are not covered.
- You or a Traveling Companion, who are on Active
Military Duty in the United States Armed Forces:
a having Your personal leave revoked within 10
days prior to Your departure date (as long as such
revocation is in writing by a superior officer and is
not due to war-related situations, invocation of the
War Powers Act, base or unit mobilization, unit
reassignment for any reason, or disciplinary
action); or
b. are personally reassigned within 10 days prior to
Your departure date, whether temporary or
permanent.
- You or a Traveling Companion being the victim of a
Felonious Assault within 10 days prior to Your
departure date. A Felonious Assault may not be
inflicted by You, a Family Member, Traveling
Companion or Traveling Companion's Family
Member.
- You or a Traveling Companion, after having been with
the same employer for at least one year, are
terminated or laid off, through no fault of Your own,
after Your effective date of coverage.
- Your family or friends living abroad with whom You
were planning to stay, are unable to accommodate
You due to life threatening Illness, life threatening
Injury or death of one of them
- A covered Travel Delay that results in the loss of more
than 50% of Your scheduled Trip length.
- You or a Traveling Companion become legally
separated or divorced after the purchase of insurance
and prior to the departure date, provided that the
insurance was purchased within 14 calendar days of
the initial Trip deposit or payment.
- For Trip Cancellation only: Your Normal Pregnancy as
long as the pregnancy occurs after Your effective date
of coverage that can be verified by medical records.
- For Trip Cancellation only: You will be attending an
Immediate Family Member's Childbirth as long as the

volcano, earthquake, hurricane or other natural disaster;
d) being called to the emergency service of government
in the case of military, police or fire personnel to provide
aid or relief in the event of a natural disaster;
e) a documented theft of passports or visas;
f) a transfer of employment of 250 miles or more;
g) a Terrorist Act which occurs in your departure city or
in a city which is a scheduled destination for your Trip
provided: 1) The Terrorist Act occurs within 30 days of
the Scheduled Departure Date for your Trip; and 2)
Your premium is received within 15 days of the initial
deposit/payment for your Trip;
h) a cancellation of your Trip if your arrival on the Trip is
delayed and causes you to lose 50% or more of the
scheduled Trip duration due to the reasons covered under
items #1 and #2 above;
i) your involuntary termination of employment or layoff
which occurs more than 30 days after your effective
date of coverage and was not under your control. You
must have been continuously employed with the same
employer for 2 years prior to the termination or layoff.
This provision is not applicable to temporary employment,
independent contractors or self-employed persons.

We will pay for non-refundable, unused payments and deposits, not to exceed the lesser of the amount of the total trip protection purchased, or the Maximum Benefit shown on the Certificate Schedule, if the Insured’s Covered Trip is cancelled for any one of the following reasons which occurs after the Insured’s Effective Date: A. Illness, Injury or Death to the Insured Person, an Insured’s Family Member, a Travel Companion or a Travel Companions Family Member. Injury or Illness must be so disabling as to reasonably cause a Covered Trip to be delayed or cancelled upon the advice of a Physician. B. Bankruptcy or Financial Default of a Travel Supplier (other than the Travel Supplier from whom the Insured purchased this coverage) which stops service more than 30 days following the Insured’s Effective Date. Whenever You are prevented from taking or completing a Covered Trip as a result of any of the unforeseen events listed below, We will reimburse You up to the Maximum Benefit Amount for Trip Cancellation or Trip Interruption, for the following expenses:
- any unused non-refundable prepaid expenses for Travel Arrangements;
- any Published Penalties You incur as a result of a trip cancellation;
- one way Economy Transportation, less the value of any unused return travel ticket, to return to the Point of Origin or to continue on Your Covered Trip when an interruption in Your Covered Trip occurs; or
- up to $150 for any reissue fee charged by the airline for Your airfare if Your Travel Supplier cancels Your Covered Trip or repositions the cruise ship or departure location. You must have covered the entire cost of the Covered Trip including the airfare.
Trip Cancellation must result from an unforeseen event that occurs after Your Effective Date and before Your Scheduled Departure Date. Trip Interruption must result from an unforeseen event that occurs after Your Scheduled Departure Date.
Single Supplement Upgrade
We will reimburse You for the single supplement upgrade cost when Your Traveling Companion cancels his or her travel plans with You, or interrupts Your Covered Trip as a result of one of the unforeseen events listed below, and You decide not to cancel or interrupt Your Covered Trip.
Unforeseen Events
As used in this provision, unforeseen events are as follows:
- Any serious Injury or any serious Sickness occurring to:
a) You, which results in medically imposed travel restrictions as certified by a Physician at the time of loss;
b) Your Business Partner or a Traveling Companion, which is so disabling as to cause a reasonable person to delay, cancel, or interrupt her trip;
c) Your or Your Traveling Companion’s Family Member that is considered life threatening or requiring hospitalization; or
d) Your or Your Traveling Companion’s Family Member requiring Your or Your Traveling Companion’s immediate care.
- Your death, the death of Your Family Member, Business Partner or Your Traveling Companion or Your Traveling Companion’s Family Member.
- Bankruptcy or Default of a Travel Supplier, other than the travel agency or organization from whom You purchased the Travel Arrangements. Benefits are provided only for the expenses charged by the Travel Supplier whose Bankruptcy or Default results in loss covered by the Policy and which stops service:
a) more than 15 days following Your Policy Effective Date for Trip Cancellation; or
b) after Your Scheduled Departure Date for Trip Interruption
provided You purchased this insurance within 15 days from the date You paid the initial deposit on Your Covered Trip.
No coverage is provided for the total cessation or complete suspension of operations by a Travel Supplier caused by fraud or negligent misrepresentation by such Travel Supplier.
- A Terrorist Incident in Your city of departure or Destination occurring after Your Effective Date, if You are scheduled to arrive in or depart from that city within 30 days following the Terrorist Incident.
- Documented theft of Your or Your Traveling Companion’s passports and/or visas required for the Covered Trip.
- A traffic accident directly involving You or Your Traveling Companion, as documented by a police report, while enroute to the Point of Origin.
- Your or Your Traveling Companion’s place of business being made unsuitable for the transaction of business by fire, vandalism, burglary or Natural Disaster.
- Death, hospitalization, or quarantine of Your Host at Destination.
- You or Your Traveling Companion are hijacked, quarantined, called for jury duty, or called for a court ordered appearance as a witness (except law enforcement officers) in a legal action in which You or Your Traveling Companion are not a party.
- You or Your Traveling Companion are transferred by the employer with whom You or Your Traveling Companion are employed as a full-time active employee at the time You enrolled for this insurance. Such transfer must result in You or Your Traveling Companion having to relocate 250 miles or more from Your or Your Traveling Companion’s original Primary Residence.
- You or Your Traveling Companion being called to the emergency service of the government in response to a Natural Disaster.
- Your arrival at Your Destination is delayed and causes You to lose 50% or more of the scheduled Covered Trip duration due to any the unforeseen events covered under Trip Delay.
- Involuntary termination or layoff affecting You or Your Traveling Companion. Employment must have been on an active full-time basis and with the same employer for at least 3 continuous years immediately preceding the termination or layoff.
- An Organized Labor Strike that causes complete cessation of travel services delaying the departure of Your Covered Trip for at least 24 consecutive hours.
- Inclement Weather which causes Your Common Carrier to delay the departure of Your Covered Trip for at least 24 hours.
- Your or Your Traveling Companion’s Primary Residence or Destination accommodations being made uninhabitable during Your Covered Trip by fire, vandalism, burglary or Natural Disaster.
Your Duties in the event of Trip Cancellation or Trip Interruption
All cancellations or interruptions must be reported to the Travel Supplier within 72 hours of the unforeseen event causing the need to cancel or interrupt Your Covered Trip, unless the event prevents it, and then as soon as is reasonably possible. If the cancellation or interruption is not reported within the specified 72 hour period, We will not pay for additional expenses or charges which would not have been incurred had You notified the Travel Supplier in the specified period. If the unforeseen event prevents You from reporting the cancellation or interruption, the 72 hour notice requirement does not apply. However, You must, if requested, provide proof that the unforeseen event prevented You from reporting the cancellation or interruption within the specified period.
In order to qualify for reimbursement under this provision, You must submit to Us with Your claim:
- the date Your Covered Trip was canceled or interrupted;
- copies of Your travel invoices;
- the original, unused travel tickets or vouchers;
- Your Travel Supplier’s cancellation clause with regard to non-refundable costs, charges or expenses;
- receipts or other proofs of payment;
- detailed medical documentation if the trip cancellation or trip interruption was caused by or resulted from a serious Injury or serious Sickness; and
- any other information We deem necessary to properly adjudicate Your claim.

Trip Cancellation: We will pay for non-refundable, unused payments and deposits, not to exceed the lesser of the amount of the total trip protection purchased, or the Maximum Benefit shown on the Certificate Schedule, if the Insured’s Covered Trip is cancelled or interrupted for any one of the following reasons which occurs after the Insured’s Effective Date: 1.Illness, Injury or Death to the Insured Person, an Insured’s Family Member, a Travel Companion or a Travel Companions Family Member. Injury or Illness must be so disabling as to reasonably cause a Covered Trip to be delayed, cancelled or interrupted upon the advice of a Physician. 2. Bankruptcy or Financial Default of a Travel Supplier (other than the Travel Supplier from whom the Insured purchased this coverage) which stops service more than 30 days following the Insured’s Effective Date. Bankruptcy or Financial Default of a Travel Supplier within 30 days of the Insured’s Effective Date is excluded from coverage. For the Bankruptcy or Financial Default coverage to apply, the coverage must be purchased within 14 days from the date of the initial deposit for the Covered Trip. 3.A Terrorist Incident after the Effective Date, if the Insured is scheduled to arrive at their Destination within 10 days following the Terrorist Incident and, for Trip Interruption, the Travel Supplier is not offering a substitute itinerary. Coverage for travel to the Insured’s Destination for which travel warnings have been issued at the time this coverage is purchased is excluded. Coverage for travel to the Insured’s Destination in which such a documented and reported Terrorist Incident has occurred in the 12 months prior to the purchase of the coverage is excluded. 4.Organized Labor Strike, natural disasters or bad weather resulting in the complete cessation of services by a Travel Supplier for at least 24 consecutive hours. 5.Insured Person or Travel Companion being hijacked, medically quarantined by order of a governmental health authority. 6. Jury Duty when a jury summons is issued after the Insured's Effective Date or the Insured Person is served with a court order issued after the Insured’s Effective Date requiring the Insured Person to appear during the time period for the Covered Trip. 7.Insureds or Travel Companions home made uninhabitable by fire, windstorm, vandalism or flood. 8.A traffic Accident directly involving either the Insured Person or Travel Companion, substantiated by a police report, while en route to a scheduled departure point. 9.The Insured Person or Travel Companion, who is on active military duty in the United States Armed Forces or an active duty police officer or fire fighter: (1) having his or her personal leave revoked within 10 days prior to his or her Departure Date (as long as such revocation is in writing by a superior officer and is not due to war-related situations, Terrorist Incident, invocation of the War Powers Act, base or unit mobilization, unit reassignment for any reason, or disciplinary action); or (2) personal reassignment within 10 days prior to his or her Departure Date, whether temporary or permanent. 10.Employee termination or layoff if the Insured Person has been employed by the same employer for at least 1 year prior to the Insured’s Effective Date. |

We will pay a Pre-Departure Trip Cancellation Benefit, up to
the amount in the Schedule, if, for a covered reason that occurs
before departure on your Trip and while coverage is in effect,
you are prevented from taking your Trip.
Covered reasons for Pre-Departure Trip Cancellation are:
1) your, an Immediate Family Member’s, Traveling
Companion’s, or Business Partner’s Sickness; Injury; Mental,
Nervous, or Psychological Disorders requiring inpatient
hospitalization of three (3) days or more; or death; 2) death or
hospitalization of your Host, as defined; or 3) for Other Covered
Events, as defined. The Sickness or Injury must: a) commence
while your coverage is in effect under the policy; b) require the
examination and treatment by a Physician at the time the Trip is
canceled; and c) in the written opinion of the treating Physician,
be so disabling as to prevent you from taking your Trip.
Pre-Departure Trip Cancellation Benefits: If you cancel your
Trip for a covered reason, we will reimburse you, up to the amount
in the Schedule for the amount of prepaid, forfeited, non-refundable
Payments or Deposits that you paid for your Trip.
We will pay your additional cost as a result of a change in the
per person occupancy rate for prepaid travel arrangements if
a Traveling Companion’s Trip is canceled and your Trip is not
canceled.
“Other Covered Events” means only the following
unforeseeable events or their consequences which occur while
coverage is in effect under this Policy:
- Air Carrier delays resulting from inclement weather, mechanical
breakdown of the aircraft on which you are scheduled to travel
or organized labor strikes that affect public transportation;
- arrangements canceled by an airline or cruise line resulting
from inclement weather, mechanical breakdown of the aircraft
on which you are scheduled to travel, organized labor strikes
that affect public transportation, or a government-mandated
shut down of an airport or air traffic control system for reasons
other than a Terrorist Act or an act of war;
Items #1 and #2 above apply only to Post-Departure
Trip Interruption Benefits and are subject to a limit
per person of $1,000, subject to a total family
maximum limit of $2,500.
- arrangements canceled by an airline, cruise line or tour
operator resulting from Financial Insolvency as defined.
Item #3 above is subject to your premium being
received within 15 days of the initial deposit/payment
for your Trip.
- a change in plans by you, an Immediate Family Member
traveling with you, or Traveling Companion resulting from
one of the following events which occurs while coverage
is in effect under this Policy:
a) being directly involved in a documented traffic accident
while en route to departure;
b) being hijacked, quarantined (except as the result of an
epidemic or pandemic), required to serve on a jury, or
required by a court order to appear as a witness in a
legal action, provided you, an Immediate Family Member
traveling with you or a Traveling Companion is not 1) a
party to the legal action, or 2) appearing as a law
enforcement officer;
c) your Home, workplace or Trip destination is made
uninhabitable by vandalism, burglary, fire, flood, volcano,
earthquake, hurricane or other natural disaster;
d) being called to the emergency service of government in
the case of military, police or fire personnel to provide
aid or relief in the event of a natural disaster;
e) a documented theft of passports or visas;
f) a transfer of employment of 250 miles or more;
g) a Terrorist Act which occurs in your departure city or in
a city which is a scheduled destination for your Trip
provided the Terrorist Act occurs within 30 days of the
Scheduled Departure Date for your Trip;
h) a cancellation of your Trip if your arrival on the Trip is
delayed and causes you to lose 50% or more of the
scheduled Trip duration due to the reasons covered under
items #1 and #2 above.<.p> |

Trip Cancellation/Trip Interruption: The Insurer will pay a benefit,
up to the maximum shown on the Schedule of Coverage and
Services, if You are prevented from taking or continuing Your Trip
due to the following Unforeseen events:
- a) Sickness, Accidental Injury, or death of You, Your Traveling
Companion, or a Family Member or Business Partner of You or Your
Traveling Companion which results in medically imposed restrictions
as certified by a Physician at the time of loss preventing Your continued
participation in the Trip. A Physician must advise cancellation
of the Trip on or before the Scheduled Departure Date.
- b) Strike that causes complete cessation of services for at least 24
consecutive hours.
- c) Weather which causes complete cessation of services of Your
Common Carrier for at least 24 consecutive hours.
- d) You or Your Traveling Companion are terminated or laid off from
employment subject to three years of continuous employment at the
place of employment where terminated.
- e) You or Your Traveling Companion are hijacked, quarantined,
required to serve on a jury, subpoenaed or required to appear as a
witness in a legal action, provided You or a Traveling Companion
are not a party to the legal action or appearing as a law enforcement
officer, the victim of felonious assault within 10 days of departure;
or having Your principal place of residence made uninhabitable
by fire, flood, or other Natural Disaster; or burglary of Your principal
place of residence within 10 days of departure.
- f) If within 30 days of Your departure, a politically motivated
Terrorist Attack occurs within the territorial limits of the City listed on
Your itinerary. The Terrorist Attack must occur after the Effective
Date of Your Trip Cancellation coverage.
- g) You or Your Traveling Companion who are military personnel,
and are called to emergency duty for a disaster other than war or
are called to active military duty, have their leave revoked or are
reassigned for reasons other than war.
- h) You or Your Traveling Companion being directly involved in a
traffic Accident substantiated by a police report, while en route to
departure.
- i) The death or hospitalization of Your Host at Destination.
- j) Natural Disaster at the site of Your destination which renders
Your destination accommodations uninhabitable.
- k) Your normal pregnancy or attending the childbirth of Your Family
Member. The pregnancy must occur after the Plan Effective Date
and be verified by medical records.
- l) Mandatory evacuation ordered by local authorities at Your
destination due to hurricane or other Natural Disaster. You must
have 50% or less of Your Trip remaining at the time the mandatory
evacuation ends, in order for this benefit to be payable.
Trip Cancellation (not applicable if $0 Trip cost displayed on
Your Confirmation of Benefits): Non-refundable cancellation
charges imposed by Your Travel Supplier and/or airfare cancellation
charges for flights joining or departing Your Land/Sea Arrangements;
or the additional costs You may incur as a result of a change in the
per-person occupancy rate of prepaid travel arrangements if a person
booked to share accommodations with You cancels his/her Trip
for a covered reason and You do not cancel. If Your Travel Supplier
cancels Your Trip, You are covered up to the cost of the ticket or the
reissue fee charged by the airline for the tickets. You must have
covered the entire cost of the Trip including the airfare.
If You purchase Sports Coverage the Insurer will pay up to the combined
maximum limit shown on the Schedule of Coverage and
Services for prepaid non-refundable ski passes, greens fees and
sporting equipment rental.
All cancellations must be reported directly to the Travel Supplier
within 72 hours of the event causing the need to cancel, unless the
event prevents it, and then as soon as is reasonably possible. If the
cancellation is not reported within the specified 72-hour period, the
Insurer will not pay for additional charges which would not have
been incurred had You notified the Travel Supplier in the specified
period. If the event prevents You from reporting the cancellation, the
72-hour notice requirement does not apply; however, You must, if
requested, provide proof that said event prevented You from reporting
the cancellation within the specified period.
