In most cases, the travel insurance provider will not know if a claim is the result of having too much to drink, however, it’s important to remember all travel insurance providers require documentation for a claim to be processed. If alcohol is included in the reports, the travel insurance provider could deny the claim.

So how much can someone drink while they are on vacation? Most travel insurance providers will typically look at the level of intoxication as found in the documentation and make their judgement based on the legal level allowed in that jurisdiction.

In addition, travel insurance providers will also refuse coverage if someone participates in an illegal act or crime. “Travel Insurance specifically looks to protect a traveler from the unexpected occurrence that interferes with their travel plans and is not intended to protect a traveler from a loss that occurs due to their own decision making,” says Buggy. “Should the insured choose to participate in an illegal act, they are choosing their fate at that time for what their future holds and it’s not an insurance companies responsibility to re-coup their loss.”
