BAGGAGE COVERAGE

We will reimburse you, up to the amount shown in the Schedule, for direct loss, theft, damage or destruction of your Baggage, passports or visas during your Trip, provided you have taken reasonable steps to protect your Baggage against loss, theft, damage and destruction. Under this coverage, we will also provide benefits for the administrative fees to reissue lost, stolen or damaged tickets, visas or passports. We will also pay for loss due to unauthorized use of your credit cards, if you have complied with all of the credit card conditions imposed by the credit card companies.

Valuation and Payment of Loss

Payment of loss under the Baggage Benefit will be calculated based upon an Actual Cash Value basis. For items without receipts, payment of loss will be calculated based upon 75% of the Actual Cash Value at the time of loss. At our option, we may elect to repair or replace your Baggage.

We may take all or part of damaged Baggage as a condition for payment of loss. In the event of a loss to a pair or set of items, we will:

1. repair or replace any part to restore the pair or set to its value before the loss; or

2. pay the difference between the value of the property before and after the loss.

Continuation of Coverage

If the covered Baggage, passports or visas are in the custody of a Common Carrier, and delivery is delayed, this coverage will continue until the property is delivered to you. This continuation of coverage does not include loss caused by or resulting from the delay.

Items Not Covered

We will not pay for damage to or loss of:

1. animals; or

2. Business Equipment, sporting equipment, household furniture, musical instruments, brittle or fragile articles; or

3. boats, motors, motorcycles, motor vehicles, aircraft, and other conveyances or equipment, or parts for such conveyances; or

4. artificial limbs or other prosthetic devices, artificial teeth, dental bridges, dentures, dental braces, retainers or other orthodontic devices, hearing aids, any type of eyeglasses, sunglasses or contact lenses; or

5. documents or tickets (except for administrative fees required to reissue tickets, as noted above); or

6. money, stamps, stocks and bonds, postal or money orders, securities, accounts, bills, deeds, food stamps or credit cards, except as noted above; or

7. property shipped as freight or shipped prior to the Scheduled Departure Date; or

8. telephones, computer hardware or software; or consumables, medicines, perfumes, cosmetics and perishables; or

9. items seized by any government, government official or customs official; or

10. illegal drugs and contraband.

Losses Not Covered

We will not pay for loss arising from:

1. defective materials or craftsmanship; or

2. normal wear and tear, gradual deterioration, inherent vice; or

3. rodents, animals, insects or vermin; or

4. mysterious disappearance; or

5. electrical current, including electric arcing that damages or destroys electrical devices or appliances. Your Duties in the Event of a Loss

In case of loss, theft or damage to Baggage, you must:

1. immediately report the incident to the hotel manager, tour guide or representative, transportation official, local police or other local authorities and obtain their written report of your loss; and

2. take reasonable steps to protect your Baggage from further damage, and make necessary, reasonable and temporary repairs. We will reimburse you for these expenses. We will not pay for further damage if you fail to protect your Baggage.

If You have checked Your property with a Common Carrier and delivery is delayed, coverage for Baggage will be extended until the Common Carrier delivers the property.

The following exclusions and limitations apply to Baggage and Personal Effects and Baggage Delay:

We will not provide benefits for any loss or damage to:

1) animals;

2) automobiles and automobile equipment; boats or other vehicles or conveyances; motorcycles; trailers; motors; or aircraft;

3) bicycles, except when checked as baggage with a Common Carrier;

4) household effects and furnishings; antiques and collector items;

5) eyeglasses, sunglasses, contact lenses, artificial teeth, dentures, dental bridges, or retainers, or other orthodontic devices or hearing aids;

6) artificial limbs or other prosthetic devices;

9) professional or occupational equipment or property, whether or not electronic business equipment;

We will not provide benefits for any loss or damage caused by or resulting from:

1) breakage of brittle or fragile articles;

2) wear and tear or gradual deterioration;

3) confiscation or appropriation by order of any government or custom’s rule;

4) theft or pilferage while left in any unlocked or unattended vehicle;

5) property illegally acquired, kept, stored or transported;

6) Your negligent acts or omissions;

7) property shipped as freight or shipped prior to the Scheduled Departure Date;

8) electrical current, including electric arcing that damages or destroys electrical devices or appliances; 9) insects, vermin or inherent vice.

We will not provide benefits for any loss or damage to Your Baggage which has been reimbursed by a Common Carrier, hotel or Travel Supplier.

32.9 LOST CHECKED LUGGAGE -­‐ Subject to the Benefits and Limits set forth in the SCHEDULE OF BENEFITS AND LIMITS in Section 21. Scheme Administrator will consider paying if the following provisions are met.

32.9.1 Replacement of clothing and hygiene items not to exceed $100 for any one item.

32.9.2 The Participating Member(s) must be in compliance with all conditions and restrictions of this coverage.

32.9.3 Lost checked luggage must have been checked, in accordance with routine luggage checking procedures of the carrier, for transportation with the Participating member(s), on board a regularly scheduled commercial airline or cruise line, upon which the Participating Member(s) was a fare-­‐paying passenger

32.9.4 The Participating Member(s) must file a formal claim for lost checked luggage with the transportation carrier, and follow all instruction and take all measures as directed by the transportation carrier to locate and retrieve all lost checked luggage.

32.9.5 The Participating Member(s) must provide the Scheme Administrator with copies of all documentation of the claim filed with the transportation carrier, and a written statement from the transportation carrier that the luggage was checked and after careful search, the luggage remains missing.

32.9.6 The lost checked luggage must be lost as of the date of payment by the Scheme Administrator and, as of that date, must have been lost for thirty (30) days.

BAGGAGE AND PERSONAL EFFECTS

If Your Baggage, personal effects, passports, travel documents or visas are lost, damaged, or stolen during Your Trip, the Company will pay the lesser of: a) the cash value (original cash value less depreciation) as determined by the Company or, b) the cost of replacement, up to the Maximum Limit shown in the Schedule subject to the special limitations shown below.

Special Limitations:

Notwithstanding the foregoing, the Company will cover up to the maximum amount indicated for the following:
· $500 for the first item
· $250 per each additional item
· $500 aggregate on all Losses to: jewelry, watches, furs, cameras and camera equipment, camcorders, computers, electronic devices, including but not limited to: lap top computers, cell phones, electronic organizers and portable CD players.

If Your Baggage, personal effects, passports, travel documents and visas are lost, damaged, or stolen during Your Trip, the Company will pay the lesser of: a) the cash value (original cash value less depreciation) as determined by the Company or, b) the cost of replacement, up to the Maximum Limit shown in the Schedule subject to the special limitations shown below.

Special Limitations:

Notwithstanding the foregoing, the Company will cover up to the maximum amount indicated for the following:

• $500 for the first item
• $250 per each additional item

The Baggage and personal effects must be owned by and accompany You during the Covered Trip. There is a per article limit shown on the Schedule of Benefits. O. LOST LUGGAGE – Subject to the limits set forth in the Schedule of Benefits/Limits, the Company will reimburse the Insured Person for the cost of lost checked luggage when such luggage was permanently lost in transit by a Common Carrier during the Period of Coverage, subject to the following conditions:

Benefits will be provided to You, up to the Maximum Benefit Amount shown in the Schedule of Benefits:

a) against all risks of permanent loss, theft or damage to Your Baggage and Personal Effects;
b) subject to all General Exclusions and the Additional Limitations and Exclusions Specific to Baggage and Personal Effects in the Policy; and
c) occurring while coverage is in effect.

Valuation and Payment of Loss: The lesser of the following amounts will be paid:

1. the Actual Cash Value at the time of loss, theft or damage, except as provided below;
2. the cost to repair or replace the article with material of a like kind and quality; or
3. two hundred fifty dollars ($250) per article.

For claimed items without original receipts, payment of loss will be calculated based upon fifty percent (50%) of the Actual Cash Value at the time of loss, not to exceed two hundred fifty dollars ($250) per article.

Additional Claims Provisions Specific to Baggage

Your Duties After Loss of or Damage to Property or Delay of Baggage: In case of loss, theft, damage or delay of baggage or personal effects, and You must:

a) take all reasonable steps to protect, save or recover the property:
b) promptly notify, in writing, either the police, hotel proprietors, ship lines, airlines, railroad, bus, airport or other station authorities, tour operators or group leaders, or any Common Carrier or Bailee who has custody of Your property at the time of loss:
c) produce records needed to verify the claim and its amount, and permit copies to be made:
d) send proof of loss as soon as reasonably possible after date of loss, providing date, time, and cause of loss, and a complete list of damaged/lost items: and
e) allow the company to examine baggage or personal effects, if requested.

These benefits will not duplicate any other benefits payable under the Policy or any coverage(s) attached to the Policy.

Baggage and Personal Effects does not include:

1. animals;
2. automobiles and automobile equipment;
3. boats or other vehicles or conveyances;
4. trailers;
5. motors;
6. aircraft;
7. bicycles, except when checked as baggage with a Common Carrier;
8. household effects and furnishings;
9. antiques and collectors’ items;
10. eyeglasses, sunglasses, contact lenses, artificial teeth, dentures, dental bridges, retainers, or other orthodontic devices or hearing aids;

e) property illegally acquired, kept, stored or transported;
f) Your negligent acts or omissions; or
g) property shipped as freight or shipped prior to the Scheduled Departure Date;

Baggage Delay: If, while on a Trip, Your checked baggage is delayed or misdirected by a Common Carrier for more than 12 hours from Your time of arrival at a destination other than Your return destination, benefits will be paid, up to the Maximum Benefit Amount shown in the Confirmation of Benefits, for the actual expenditure for necessary personal effects. You must be a ticketed passenger on a Common Carrier. The Common Carrier must certify the delay or misdirection. Receipts for the purchases must accompany any claim.

We will reimburse You, less any amount paid or payable from any other valid and collectible insurance or indemnity, up to the amount shown in the Confirmation of Benefits, for the cost of reasonable additional clothing and personal articles purchased by You, if Your Baggage is delayed for 12 hours or more during Your Trip.

Additional Limitations and Exclusions Specific to Baggage and Personal Effects:

Benefits are not payable for any loss caused by or resulting from:

a) breakage of brittle or fragile articles;

b) wear and tear or gradual deterioration;

c) confiscation or appropriation by order of any government or custom’s rule;

Additional Claims Provisions Specific to Baggage

Your Duties After Loss of or Damage to Property or Delay of Baggage: In case of loss, theft, damage or delay of baggage or personal effects, and You must:

a) take all reasonable steps to protect, save or recover the property:

b) promptly notify, in writing, either the police, hotel proprietors, ship lines, airlines, railroad, bus, airport or other station authorities, tour operators or group leaders, or any Common Carrier or bailee who has custody of Your property at the time of loss:

c) produce records needed to verify the claim and its amount, and permit copies to be made:

The baggage and personal effects must be owned by and accompany You at all times. Benefits will be paid to the maximum stated in the Schedule of Benefits. The plan will pay the lesser of the following:

1. The actual cash value (cost less proper deduction for depreciation at the time of loss);

2. The cost to repair or replace the article with material of a like kind and quality; or

3. $50 per article.

This coverage is secondary to any coverage provided by a Common Carrier. You must furnish proof to the Underwriter that full reimbursement has been obtained from the airline.

This plan will reimburse You for lost baggage and personal effects checked with a Common Carrier provided You have taken all reasonable measures to protect, save and/or recover Your property at all times.
