POLITICAL OR SECURITY EVACUATION

We will pay, up to the Maximum Benefit Amount shown in the Schedule of Benefits, for all reasonable evacuation expenses incurred for Your transportation to the nearest safe haven, if You must leave Your Trip for a covered Political or Security Event.

Evacuation must occur within 7 days of any Political or Security Event. Arrangements will be by the most appropriate and economical means available and consistent with Your health and safety. Benefits are only payable for arrangements made by Our Program Assistance Provider.

Following an evacuation due to a Political or Security Event and when safety allows, We will pay for one-way Economy Transportation to return You to either the Host Country or Your Home Country, whichever country You designate.

POLITICAL OR SECURITY EVACUATION COVERAGE DEFINITIONS

“Home Country” means the country or territory as shown on Your passport.

“Host Country” means a country or territory You are visiting or in which You are living which is not Your Home Country.

“Political or Security Event” means: 1) a Natural Disaster; 2) civil, military or political unrest for which a formal written recommendation from the appropriate local government authorities, or the U.S. State Department, for You to leave a country is issued; or 3) You being expelled or declared a persona non-grata by a country You are visiting on Your Trip.

POLITICAL OR SECURITY EVACUATION COVERAGE CONDITIONS AND LIMITATIONS

1. The benefits and services described herein are provided to You only if Our Program Assistance Provider arranges or coordinates Your evacuation.

2. We will not pay for any loss or expense recoverable under any other insurance or through an employer.

3. Our Program Assistance Provider has sole discretion regarding the means, methods and timing of a Political or Security Evacuation. However, the decision to travel is Your sole responsibility.

4. You will be responsible for all transportation and living costs while located at the safe haven.

5. We are not responsible for the availability, timing, quality, results of, or failure to provide any service caused by conditions beyond our control. This includes Our inability to provide You an evacuation or any additional services when the rendering of such evacuation or service is prohibited by United States of America law, local laws or regulatory agencies. A Political or Security Evacuation is not covered from Afghanistan, Iraq, Somalia, Chechnya, Democratic Republic of the Congo, Iran, Israel West Bank, Israel Gaza Strip, Ivory Coast, Lebanon, Libya, North Korea, Sudan or Syria.

6. We will not pay any costs or expenses arising from:

a) Political or Security Evacuation from Your Home Country.

b) Political or Security Evacuation when the Political or Security Event precedes Your arrival in the Host Country.

c) Political or Security Evacuation when the evacuation notice has been issued or posted by the recognized government of Your Home Country or the Host Country for a period of more than seven (7) days and You have failed to notify Our Program Assistance Provider regarding Your need to be evacuated.

d) the actual or threatened use or release of any nuclear, chemical or biological weapon or device, or exposure to nuclear reaction or radiation, regardless of contributory cause.

7. We will not pay for more than one (1) Political or Security Evacuation from a country or territory per individual per Trip.

8. We will not pay for any loss or expense arising from or attributable to: a) fraudulent or criminal acts committed or attempted by You; b) alleged violation of the laws of the country You are visiting, unless We determine such allegations to be fraudulent; or c) failure to maintain required documents or visas.

9. We will not pay for any loss or expense arising from or attributable to: a) debt, insolvency, business or commercial failure; b) the repossession of any property; or c) Your non-compliance with a contract, license or permit.

10. We will not pay for any loss or expense arising from or due to liability assumed by You under any contract.

32.17 Political Evacuation — Subject to the Benefits and Limits set forth in the Schedule of

Benefits/Limits in Section 21, the Scheme Administrator will pay the following Political

Evacuation Benefits when the US Department of State issues a travel warning after the

Participating Members’ arrival in the destination country and/or after the Effective Date of

insurance;

32.17.1 The cost of transportation by the most economical means possible for the Participating Member to the nearest country of safety or to the Home Country, provided that the Participating Member contacts the Scheme Administrator within ten (10) days of the warning is issued and subject to the following conditions and restrictions; and

32.17.2 The Participating Member must be in compliance with all conditions and provisions of this evidence of insurance; and

32. 17.3 The Participating Member must have already arrived in his or her destination country when the US Department of State issues a travel warning for that country; and

32. 17.4 Determination of the country to which the Participating Member will be evacuated will be determined by the Scheme Administrator; and

32.17.5 Political Evacuation Benefits must be approved in advance and coordinated by The Scheme Administrator; and

32.17.6 The Scheme Administrator will use their best efforts to arrange any Political Evacuation within the least amount of time possible. The Participating Member understands that the timelines of evacuation can be affected by circumstances that are not within the control of the Scheme Administrator, such as, availability of transportation equipment and staff, delays or restrictions on flights caused by mechanical problems and weather. The Participating Member, and his or her heirs, agrees to hold the Scheme Administrator harmless, and the Scheme Administrator shall not be held liable for any delays that are not within their direct and immediate control.

Political and Natural Disaster Benefit

Coverage is provided up to $50,000 If Plan Participant requires emergency evacuation or return of deceased remains due to the following reasons, which places him/her in imminent bodily harm as determined by the travel assistance company security personnel, in accordance with local and U.S. authorities, the travel assistance company security shall arrange, and the company will pay for Plan Participant’s transportation to the nearest safe location:

1) Officials of the Foreign Country or the embassy of the country with which the Plan Participant is a national has issued for reasons other than medical, a recommendation that categories of persons which include the Plan Participant should leave the Foreign Country; and/or
2) Plan Participant is being expelled or declared persona non grate on the written authority of the recognized government of the Foreign Country; and/or

3) The Political and Military Events in the Foreign Country have created a situation in which the Plan Participant is in danger of Imminent Bodily Harm to the extent that the Plan Participant must be removed from the Foreign Country; and/or

4)Officials of the Foreign Country or the embassy of the country with which the Plan Participant is a national has issued for reasons due to the Natural Disaster situation, a recommendation that categories of persons which include the Plan Participant should leave the Foreign Country; AND

5) Plan Participant cannot obtain commercial transportation to the nearest safe location within a time period which will enable the Plan Participant to leave the Foreign Country in time to avert Imminent Bodily Harm or to comply with the time allowed to leave the Foreign Country pursuant to the orders of the recognized government of that Foreign Country. The Plan Participant must contact the Travel Assistance Company as soon as possible, as delays may make safe transportation impossible. The method of transportation will be as deemed most appropriate to ensure Plan Participant’s safety. If evacuation becomes impractical due to hostile or dangerous conditions, Travel Assistance Company will maintain contact with and advise the Plan Participant until evacuation becomes viable or the Natural Disaster situation has been resolved. The Assistance Company shall arrange and the plan will pay up to $100 per day up to a maximum of five (5) days for reasonable expenses related to lodging if the Plan Participant is delayed at a safe haven. Travel Assistance Company shall also arrange and pay for one-way economy airfare to return Plan Participant to his/her Home Country following an Evacuation. Economy airfare and lodging costs shall not exceed a combined single limit of $5,000 USD. Should commercial flights be available, but transportation to the airport will place the Participant in Imminent Bodily Harm, Travel Assistance Company shall arrange and pay for his/her secure transport to the airport.
Airfare change fees are the responsibility of the Participant once he/she reaches an airport where normal commercial flight is available.

No benefit shall be payable if there is a travel warning in effect within 60 days prior to the Plan Participant person’s date of arrival in the host country. The Assistance Company must make all arrangements for the Plan Participant. Services rendered without the Travel Assistant Company’s coordination and approval is not covered. No claims for reimbursement will be accepted. If the Plan Participant is able to leave their host country by normal means, such as changing a commercial airline ticket, the Assistant Company will assist in rebooking flights or other transportation. Expenses for non-emergency transportation are the responsibility of the Participant.

Non-Medical Emergency Evacuation Exclusions: We do not cover:

1) loss or expense for a Non-Medical Emergency Evacuation Covered Reason which took place in an Excluded Country;

2) loss or expense recoverable under any other insurance or through an employer;

3) loss or expense arising from or attributable to:

a) fraudulent or criminal acts committed or attempted by You;

b) alleged violation of the laws of the country You are visiting, unless We determine such allegations to be fraudulent, or

Political and Natural Disaster Benefit -

Coverage is provided up to $50,000 If Plan Participant requires emergency evacuation or return of deceased remains due to the following reasons, which places him/her in imminent bodily harm as determined by the travel assistance company security personnel, in accordance with local and U.S. authorities, the travel assistance company security shall arrange, and the company will pay for Plan Participant’s transportation to the nearest safe location:

1) Officials of the Foreign Country or the embassy of the country with which the Plan Participant is a national has issued for reasons other than medical, a recommendation that categories of persons which include the Plan Participant should leave the Foreign Country; and/or

2)Plan Participant is being expelled or declared persona non grate on the written authority of the recognized government of the Foreign Country; and/or

3) The Political and Military Events in the Foreign Country have created a situation in which the Plan Participant is in danger of Imminent Bodily Harm to the extent that the Plan Participant must be removed from the Foreign Country; and/or

4) Officials of the Foreign Country or the embassy of the country with which the Plan Participant is a national has issued for reasons due to the Natural Disaster situation, a recommendation that categories of persons which include the Plan Participant should leave the Foreign Country; AND

5)Plan Participant cannot obtain commercial transportation to the nearest safe location within a time period which will enable the Plan Participant to leave the Foreign Country in time to avert Imminent Bodily Harm or to comply with the time allowed to leave the Foreign Country pursuant to the orders of the recognized government of that Foreign Country. The Plan Participant must contact the Travel Assistance Company as soon as possible, as delays may make safe transportation impossible. Maximum Limit: $25,000

1) Subject to the applicable Maximum Limit set forth in the BENEFIT SUMMARY, and the other Terms of this insurance, including the EXCLUSIONS provision and the CONDITIONS AND RESTRICTIONS subparagraph below, the Company will reimburse the Insured Person for the following transportation and accommodation costs, when the Company or Plan Administrator arranges such transportation and accommodations, and expenses incurred by the Insured Person arise out of or in connection with an evacuation due to a Natural Disaster that makes your Destination Country Uninhabitable during the Period of Coverage:

a) air or ground transportation to the nearest safe location

b) the cost of a one-way economy commercial airline ticket, if the Conditions and Restrictions are met below, to return the Insured Person to his/her Country of Residence following the Natural Disaster evacuation

c) a maximum of three (3) days for reasonable and necessary lodging accommodations if the Insured Person is delayed in a safe location and unable to return to his/her Country of Residence.

2) CONDITIONS AND RESTRICTIONS: To be eligible for coverage for Natural Disaster Evacuation benefits, the Insured Person must be in compliance with all Terms of this insurance. Expenses for non-emergency transportation are the Insured Person’s sole responsibility. The Company will provide Natural Disaster Evacuation benefits only when all of the following conditions and restrictions are met:

a) the Natural Disaster Evacuation must have been ordered and mandated by the recognized governmental authorities having jurisdiction over the location within the Insured Person’s Destination Country

b) the Insured Person is unable to leave their Destination Country by normal means, including but not limited to changing an existing Common Carrier reservation to arrange for an earlier return due to the Natural Disaster

c) the Insured Person is unable to obtain commercial transportation within the Destination Country to travel to the nearest safe location in a time period that would:

i) avoid Imminent Bodily Harm

ii) comply with the time allowed to leave the Destination Country pursuant to the orders of the recognized government of the Insured Person’s Destination Country

iii) comply with the time allowed by officials of the Destination Country or the U.S. Embassy

d) the Insured Person’s location in the Destination Country is deemed Uninhabitable by the Company

e) the Insured Person must contact the Company as soon as reasonably possible after the Destination Country has issued an official disaster declaration

f) Natural Disaster Evacuation is approved in advance by the Company.

By acceptance of this Certificate and request for Natural Disaster Evacuation benefits hereunder, the Insured Person understands, acknowledges and agrees that the timeliness, duration, occurrences during and outcome of an Natural Disaster Evacuation can be directly and indirectly affected by events and/or circumstances that are not within the supervision or control of the Company, including but not limited to: the availability, limitations, physical condition, reliability, maintenance and training schedules and procedures and performance or non-performance of competent transportation equipment, supplies and/or staff of such third-party contractors; delays or restrictions on flights or other modes or means of transportation caused by mechanical problems, government officials, telecommunications problems, non-availability of routes, and/or other travel, geographical or weather conditions; and other acts of God and unforeseeable and/or uncontrollable occurrences.

The Insured Person agrees to release and to hold the Company, the Plan Administrator and their agents and representatives harmless from, and agrees that the Company, the Plan Administrator and their agents and representatives shall not be held liable or responsible for, any delays, losses, damages, further Injuries or Illnesses, or any other claims that arise from or are caused in whole or in part by the acts or omissions of such independent third-party contractors or their agents, employees or representatives, or that arise from or are caused in whole or in part by any acts, omissions, events or circumstances that are not within the direct and immediate supervision and control of the Company, the Plan Administrator and/or their authorized agents and representatives, including without limitation the events and circumstances set forth above.

The Insured Person further agrees that upon seeking a Natural Disaster Evacuation, he or she will cooperate fully as required by the CONDITIONS AND GENERAL PROVISIONS, COOPERATION provision. Failure to so cooperate and/or failure to use or accept Natural Disaster Evacuation once it has been arranged by the Company or Plan Administrator will require the Insured Person to reimburse the Company for costs incurred for any Natural Disaster Evacuation that was arranged, but not used, by the Insured Person. Furthermore, the Insured Person may be required to arrange for payment of any subsequent Natural Disaster Evacuation and seek reimbursement thereafter for eligible costs associated with that subsequent Natural Disaster Evacuation.

Non-Medical Emergency Evacuation

This Non-Medical Emergency Evacuation Benefit is not available if a formal recommendation in the form of a Travel Advisory or Travel Warning from the U.S. State Department is issued for a country preceding Your arrival into that country on Your Trip, or if a country is an Excluded Country preceding Your arrival into that country on Your Trip.

You are eligible for benefits, up to the Maximum Benefit Amount shown in the Schedule of Benefits, for all reasonable expenses incurred for Your transportation to the nearest place of safety, or to Your primary place of residence, if You must leave Your Trip for a Non-Medical Emergency Evacuation Covered reason, as defined below.

Non-Medical Emergency Evacuation must occur within fourteen (14) days of any covered event. Arrangements will be by the most appropriate and economical means available and consistent with Your health and safety. Benefits are only payable for arrangements made by iTravelInsured®, Inc.

Maximum Benefit Amount: $50,000

If due to political or military events in a host country, a formal recommendation from the appropriate authorities is issued for the Insured to leave the host country or the Insured is expelled or declared persona non-grata by the host country, all reasonable expenses incurred for transportation to the nearest place of safety or for repatriation to the Insured’s home country or country of residence are covered as stated in the Schedule of Benefits. Evacuation must occur within 10 days of any such event. Coverage will apply to the most appropriate and economical means consistent under the circumstances with your health & safety. Evacuation costs will be paid once per Insured per occurrence. In the event this benefit is needed,
arrangements must be made by Seven Corners Assist. Failure to utilize Seven Corners Assist to arrange for these services will result in the denial of benefits.

c) Due to liability assured or assumed by You under any contract; or

The Company’s security personnel will determine the need for the Natural Disaster Evacuation in consultation with local governments and security analysts. It may use any appropriate resources to evacuate You including, but not limited to, charter aircraft, ground, transportation, and sea transportation in such circumstances where the point of departure may not be an international airport. You may be required to release the Company or any provider from liability during this Natural Disaster Evacuation. If a Natural Disaster Evacuation is impossible due to hostile conditions, the Company will use security resources to maintain contact with You to the greatest extent allowed by circumstance until a Natural Disaster Evacuation becomes possible or the emergency is resolved.

The Company will not be responsible for failure to provide services or for delays caused by conditions beyond its control including, but not limited to, weather conditions, flight availability, strikes, unforeseen changes to airport regulations or restrictions, Your failure to comply with the Company’s recommendations, or where rendering of service is prohibited by local laws or regulatory agencies. Further, if You can leave the Host Country location by normal means, such as changing a commercial airline ticket, no coverage applies, but the Company will assist in rebooking flights or other transportation.

The coverage provided by the Certificate under this Section 5.6. excludes Expenses that are for, result in from, related to, or incurred for the following:

a) Your Natural Disaster Evacuation or Your Natural Disaster Repatriation (i) while in the United States; (ii) while You are traveling within fifty (50) miles of Your primary residence; (iii) when the Natural Disaster situation directly giving rise to these benefits precedes Your arrival in the effected location; (iv) when the evacuation notice issued by the United States or Host Country Government has been posted for a period of more than sixty (60) days; or (v) when You elect not to depart in a timely manner or with evacuation arrangements coordinated by Seven Corners Assist, in which case the coverage under this Section 5.6 is immediately terminated;

b) Medical expenses incurred by You;

c) Expenses not related to the Natural Disaster Evacuation or Natural Disaster Repatriation including expenses for transportation from the Host Country by normal commercial means;

d) Kidnap or ransom of You; and

e) any services or other arrangements not arranged by Seven Corners Assist.

NON-MEDICAL EMERGENCY EVACUATION

You are eligible for benefits, up to the Maximum Benefit Amount shown in the Confirmation of Benefits, for all reasonable expenses incurred for Your transportation to the nearest place of safety, or to Your primary place of residence, if You must leave Your Trip for a Non-Medical Emergency Evacuation Covered Reason, as defined below.

Non-Medical Emergency Evacuation must occur within 14 days of any covered event. Arrangements will be by the most appropriate and economical means available and consistent with Your health and safety. Benefits are only payable for arrangements made by Seven Corners.

Non-Medical Emergency Evacuation Covered Reasons: We will pay for the Non-Medical Emergency Evacuation Benefits listed above if, while on Your Trip, a formal recommendation in the form of a Travel Advisory or Travel Warning from the U.S. State Department, is issued for You to leave a country You are visiting on Your Trip due to:

1) a Natural Disaster;

2) civil, military or political unrest; or

3) Your being expelled or declared a persona non-grata by a country You are visiting on Your Trip.

Non-Medical Emergency Evacuation Exclusions: We do not cover:

1) loss or expense recoverable under any other insurance or through an employer;

2) loss or expense arising from or attributable to:

a) fraudulent or criminal acts committed or attempted by You;

b) alleged violation of the laws of the country You are visiting, unless We determine such allegations to be fraudulent, or

c) failure to maintain required documents or visas;

3) loss or expense arising from or attributable to:

a) debt, insolvency, business or commercial failure;

b) the repossession of any property; or

c) Your non-compliance with a contract, license or permit;

4) loss or expense arising from or due to liability assumed by You under any contract.

These benefits will not duplicate any other benefits payable under the Policy or any coverage(s) attached to the Policy.

You are covered if an Occurrence takes place while coverage is in effect; and while you are traveling outside of your Home Country or country of residence. We will not pay Political Evacuation Expense Benefits for expenses and fees:

1. payable under any other provision of the Policy.

2. that are recoverable through the Covered Person’s employer.

3. arising from or attributable to an actual fraudulent, dishonest or criminal act committed or attempted by the Covered Person, acting alone or in collusion with other persons.

4. arising from or attributable to an alleged: violation of the laws of country in which the Covered Person is traveling while covered under the Policy; or violation of the laws of the Covered Person’s Home County or country of residence.

5. due to the Covered Person’s failure to maintain and possess duly authorized and issued required travel documents and visas.

6. for repatriation of remains expenses.

7. for common or endemic or epidemic diseases or global pandemic disease as defined by the World Health Organization.

8. for medical services.

9. for monies payable in the form of a ransom, if a Missing Person case evolves into a kidnapping.

10. arising from or attributable, in whole or in part, to: a. a debt, insolvency, commercial failure, the repossession of any property by any title holder or lien holder or any other financial cause; b. non-compliance by the Covered Person with regard to any obligation specified in a contract or license.

11. due to military or political issues if the Covered Person’s Security Evacuation request is made more than 30 days after the Appropriate Authority(ies) Advisory was issued.
